These two appeals are being disposed of by this common judgment since M.A.C.M.A.No.2O54 of 2Ol4 hled by the petitioner and M.A.C.M.A.No. 1866 of 2016 filed by the A.P.S.R.T.C. are directed against the very same judgment and decree, dated 17.06.2013 passed in M.V.O.P.No.2806 of 2O11 by the Chairman, Motor Vehicle Accidents Claims Tribunalcum-X Additional Chief Judge, City Civil Court, Hyderabad (for short "the Tribunal")

The petitioner useC tc earn Rs;.4,0O0/_ per rnonth as a seasorral fruit vendor.. In view of the injuries sustained by him, the petirioner is unable to do the fruit business. Therefore, he filed the O. p. claiming compensation of Rs.4,00,000/ -.

On behalf of the petitioner, p.Ws.l and 2 were examined and Exs.Al to AB were marked. On behalf of the respondents, no oral or documentar5r evidence was produced. 6. After considering the oral and documentar5r evidence available on record, the Tribunal held that the accident occurred due to the rash and negligent driving of the driver of the offendr'ng vehicle and accordingly awarded an amount ol Rs.3,47,O00/- u,ith interest {@ 7.5%o per annum from the date of petition till the date of reafization to be paid by responclents jointly and severally. Challenging the same, M.A.C"I\4.A.No.2O54 of 2014 is filed by the petirioner and M.A.C.M.A.No.I866 of 20 16 is frted by the A.P.S.R.T.C.

Learned Counsel appea_ring for the petitioner contended that thor-rgh the petitioner sustained 6o0l, disability', the Tribunal erroneously fixed the disability at SOo/o. The Tribunal ha.s not awarcled just compensation under other heads anrl therefore, the amc.runt arvarded b;r the Tribrrnal is ver), meager and unjustifiable.

of the petitioner at Rs.3,OOO/- per month u,ithout any proof. The Tribunal has not examined Exs.Al to Ag in proper perspective. The amount awarded by the Tribuna_l is excesslve

A perusal of the impugned judgment would show that the 'lribunal has framed issue No.l as to whether the accident had occurred due to rash anct negligent driving of the driver of the offending vehicle and after considering the evidence of P.W.1 coupled rvitl-r the documentary evidence, has observed that the respondcnts did not take any steps to examine the drivcr of RTC bus and as per the ruling reported in 2OO2(21 ALD 680, when the respondents have not examined the driver ol the bus, an adverse inference has to be <irawn against the RTC and accordingly held that the accident has occurred due to the rash and negligent driving of the driver of the offending vehicle and has answered in the favour of the petitioner and against the respondents. Therefore, this Court is not interfering with the finding of the Tribunal that the accident occurred due to the ras[-r and negligent driving of the driver of the otfending vehicle.

Insofar as the quantum of compensation^is concerned, the Tribunal has awarded an^{amount of} Rs.5,0OO/ - towards transportation charges,^{which is meager} and this Court is inclined to award an amount of^Rs.8,OOO/- towards transportation charges. With regard^{to the income,} the petitioner stated that he used to^{earn arl amount of} Rs.4,0OO/- per month as a^{seasonal fruit vendor.However,} the Tribunal disbelieved the^{version of the petitioner and hxed} the income of the petitioner at^{Rs.3,OOO/-per month. The} Honble Supreme Court in Sged. Sadiq^andOthersVs. Divisional Manage4 United. India Insurance^Compang Limitedl lixed the notional income of a^{vegetablevendor at} Rs.6,5O0/- per month. Applying the said^{decision to some} extent, the income of the^petitioner can^{be guessed to be on} the higher side and as such, this Court^{is inclined to fix the} income of the petitioner at^Rs.S,OOO l-^{pet month.The} petitioner stated that due to the injuries sustained^{by him, he} has taken bed rest for nine months.^{Therefore,the petitioner} is entitled to a sum of Rs.4S,OOO/-^{(Rs.5,000/-X 9) towards} loss o[ earnings. Though the petitioner has sustained 60% disability, the Tribunal fixed the disability at 50% and awarded a sum of Rs.2,70,O00/_ towards permanent disability.

Thus, as seen above, a disability certificate can be issued by a registered Medical Practitioner who is competent to issue the same. Therefore, considering the evidence of P.W.2 coupled with Ex.A.6-Disability Certificate, this Court is inclined to take into consideration the disability aL 6Ook instead of 50%, as the Courts ha.,,e no power to increase or decrease the disability.

At the time of the accidcnt, the age of the petitioner is 40 years. As per Sorla Verrna Vs. Delhi Transport

Corporation3, the appropriate multiplier applicable for the age of the petitioner is '15'. Hence, under the head of loss of income due to disability, the petitioner is ar.r,arded a sum of Rs.5,40,000/- (Rs.5,OO0 x 12 x 15 x 60/ i00).

Thus, in all, the petitioner is entitled to a sum of Rs.6,4B,O0O/- (Rs.8,000/- + 45,O0O/- + 20,OOOl- + 10,OO0/+ Rs.25,000/- + Rs.5,40,000/-).

The Tribunal has rightly awarded the rate of interest at 7 .5^o/o per arlnum and the same needs no interference by this Court.

Though the claimed amount is Rs.4,00,000/invoking the principle of just compensation, and in view of the Iaw laid down by the Honble Supteme Court in Rajesh os, Rajbir Singha, ald in a catena of decisions, this Court is empowered to Brant compensation beyond the claimed amount

19 Accordingly, MACMA No.2054 of 2Ol4 is allowed . by enhancing the amount of compensation lrom Rs.3,47,OOO/- to Rs.6,48,OAO/- (Rupees six lakh, forty eight thousand only) rvith interest at 7 .SVo per annum from the date of the petition till the date o[ realization. The respondents a-r'e jointly and severally liable to pay the compensation amount rvith intercst and costs, after decluctir-rg the amount, if any, deposited belore the Tribunal, s ithin a period of two months from the date of receipt of a cop1, of this^jutlgrnent.
