This appeal^{is filed against the Order dated O3'08'2005in} O.P.No.231 of^{2OO4 passedby the Chairman, Motor Accidents} Claims Tribunal-cumlV^{AdditionalDistrict Judge (Fast Track} Court), Karimnagar.

The appellant/^{petitionerfrled O'P'No'23i of2OO4'} claiming compensation^{of Rs.1,5O,0OO/-for injuries sustained} by him in the road^{trafficaccidentoccurred on 09'11'2OO3'The} petitioner was working^{as auto driver and was earning} Rs.3,OOO/ - per month^{and he met with an accident on} 09.1 1.2003 and^{was immediatelyshifted to Medbone Hospital'} Godavarikhani.

Learned counsel for^{appellant/petitioner stated thatthe} petitioner examined^{P.W.2 who is asurgeoninMedbone} Hospital, Godavarikhani^{and P.W.2 stated that the petitioner} was admitted in^{hospital on 09. 1 1} '2003^{with compound} communicate fracture^{of both bones of right leg and one} lacerated wound on right^{leg. He further stated that the patient}

undergone a surgery on 10. 11.2003 and emergency debridement and external fixati.,on with steel rods was done and discharged on 29 .11.2003 and he was again admitted on 16.12.2003 a-rrd another surgery was conducte d on tZ.l2.2OO3 for removal of steel rods and was discharg ed on 2O.12.2OO3. P.W.2 also admitted having issued Ex.A2 medical certificate, discharge card under Ex.AS and Ex.A6_final bill for Rs.2O,4lO by his hospital and p.W.2 further stated thar Ex.A6_medical bill are as per his prescriptions and he advised the petitioner to take 6 months bed rest.

Learned counsel for appellalt/petitioner stated that both the injuries are grievous in nature. The Trial Court considering the oral ald documentar5r evidence granted Rs.46,4O0/- with interest @ 9o/o per annum from the date of petition to till the date of deposit. Challenging the quantum o[ compensation as meagre, the petitioner has filed the present appeal.

Admittedly, appellant/pe titioner sustained [wo injuries which are grievous in nature, as such it is reasonable to award Rs' 18,ooo/ - for injuries. Apart from that he is arso entitled for an amount of Rs.15,O0O/_ for pain and suffering and Rs. 15,OO0/- towards loss of amenities. As the petitioner was

advised to take bed rest for a^period of 6^monthsandthe petitioner was earnirrg Rs.3,OOO/- per month, he was entitled^to Rs. 18,0OO/- per month (6 x Rs.3,0O0/-) towards^{loss of} earnings and Rs.5,O00/- towards^{transportation chargesand} Rs. 10,00O/- towards extra nourishment. Pwl^{frled hnal bill of} Rs.2O,41O/- issued by Medbone Hospital. Though^{he claimed} Rs.3O,OOO/- towards medicines and treatment charges,^{as per} Ex.A6, the Trial Court^granted Rs.2O,410/- towards^treatment charges. This Court irnds it reasonable to^{grant an amount of} Rs.2O,4 10/ - towards treatment charges. Though the^petitioner stated that he sustained 10% partial disability, it^{was not} supported by any documentary evidence.

Therefore, the appellant/petitioner is entitled for the

In the result, the appeal is allowed by enhancing the compensation amount from Rs.46,4O0/_ to Rs.1,01,410/(Rupees One Lakh One Thousand and Four Hundred and Ten only) with interest at the rate of 7.So/o per annr.rm from the date of hling the petition till date of realization. Respondent No.2/Insuralce Company shall deposit the entire arnount within a period of one month from the date of order. On such Deposit, the appellant is entitled to withdraw the said amount. There shall be no order as to costs.
