1'he petitioner-plaintiff llled O.S.No. 107 of 2016 on the file of the Principal Junior Civil Judge, Gadwal against the respondentsdefendants for perpetual Injunction restraining them fiom interfering with his peaceful possession and enjoyment over the suit schedule property i.e. agricultural land in Sy.No.3ll,4.6 to an extent of Ac.2-00 guntas situated at Neelahatli Village of Dharoor Mandal, Mahabubnagar District. In the said suit, the petitioner filed I.A.No. I l0 ol 2016 under Order XXXXIX Rules I and 2 read with Section l5l of the Code of Civil Procedure, 1908 lor grant of temporary injunction against the respondents. After hearing both sides and on consideration ol' the material on record, the said application was dismissed vide order 07.12.2016. Against the said order, the petitioner preferred CMA.No.2 of 2017 before the III Additional District and Sessions Judge, Gadwal. Respondent No. I filed counter affidavit. The appellate Coun, after having lormulated the points lor determination and on hearing both sides, allowed the appeal vide order 14.07 .20 I 7 on the ground that the petitioner
