Heard Smt B.Mohana Reddy, learned counsel for the petitioner, as well as lealned Additional Public Prosecutor who is representing the respondent-State.

Seeking the Court to enlarge the petitioner, who is arrayed as accused No.2 in Crime No.84O of 2O2l of Medipally Police Station, Rachakonda Commissionerate, on bail, the present Criminal Petition is filed under Section 439 Cr.P.C.

Making her submission, learned counsei for the petitioner contends that the petitioner has not committed any offence whatsoever and the petitioner is a mason by profession and as there was no masonry work during the pandemic period, he was working under accused No.^1.

Disputing the submission thus made,^learned Additional Pubiic Prosecutor states that the^{petitioner and} other accused were involved in transportation^{of ganja from} the agency areas to Hyderabad^{and selling the same to needy} customers and huge quantity i.e.,^{1,240 kgs of ganj a was} t

seized from their possession. Learned Additional Public Prosecutor also states that the trial proceedings are ln progress and till now, the evidence of L.Ws. 1 to 6, 9 to 1 1 were recorded and at this juncture, it is not desirable to enlarge the petitioner on bail.

A perusal of'contents of the charge sheet reveals grave allegations against the petitioner and also the other accused. The case is badly hit by Section 37 of the Narcotic Drugs and Psychotropic Substances, Act, 1985. Also, this Court does not find any justifiable grounds to enlarge the petitioner on
