bearing No. AP 25 M 6118 flom Ravigunta Palenr to Mallanr village of Chittamaru Mandal, Nellore District, during the employment under the opposite party No.l and when the vehicle reached near Kokkupalern village of Chittamuru Mandal at about 4-00 p.m., the driver of the said vehicle drove the vehicle at high specd in rash and negligent marurcr and lost control over ti'lc vehicle, due to which the vehicle turned turtle, as a result of which, the deceased- Anand and B.Sudhakar fell ciown from the vehicle and came under the vehicle, sustained multiple fractures and grievous injuries all over the body and died on the spot. l'he accident occurred during the course of employment of the deceased under opposite party No.l while discharging his duties as Assistant on Harvest combine vehicle bearing No. AP 25 M 6118. Based on the complaint, Police, Chittamaru of Nellorc District has issued F.l.R. No.8 of 2006 under Section 304-A IPC. According to the applicants, the deceased was aged about 22 years, working as Assistant on Harvest Combine vehicle and was drawing Rs.5,000/per month and Rs.50/- per day towards bata. Since the insurance policy was in force as on the date of the accident, the opposite party No. I being the owner ol the vehicle and opposite party No.2

being the insurer of the crime vehicle, are^jointly and severally liable to pay the compensation of Rs. 10,00,000/- to the applicants.

Opposite party No.l filed rvritten statement denying the income of the deceased and stated that the deceased received salary of Rs.4,5004 per month without any batta by working as Assistant of Harvest Combine vehicle bearing No. AP 25 M 6118 and admitted that the deceased met with an accident on 19.3.2006 rvhile discharging his duties. It is funher contended that the compensation claimed by the applicants is excessive and exorbitant, however, denied his liability as the'r,ehicle was insured with opposite party No.2 and insurance policy was subsisting as on the date of the accident, opposite party No.2 alone is tiable to pay compensal.ion. Thus, prayed to dismiss the application against opposite party No. 1.

Opposite party No.2 filed written statement denying the averrnents of the application denying manner of accident, age, avocation and income of the deceased. It was further contended that the claim of thc applicants is excessive and exorbitant and

On behalf of the applicants, AW. I was examined and Exs.A I to 46 were marked. Whereas, on bchatf of the opposite party No.2, RW. I was examined and got marked Ex.Bl copy of insurance policy. The leamed Comrnissioner after considering the evidencc on record both oral and documentary, has awarded Rs.2,74,056/- towards compensation and interest @ l2%o per annum frorn the date of filing of the application. The leamed Commissioner further awarded an amount of Rs.548/- torvards stamp fee and Rs.500/- towards Advocate fee.

Heard the leamed counsel for the applicants and the learned

Standing Counsel for the opposite pafty No.2-Insurance Company and perused the record.

The contention of the leamed Standing Counsel for the opposite party No.2 is that the leamed Commissioner erred in awarding compensation, even though the evidence of RWI coupled with Ex.B I insurance policy establishes that no additional premium was paid to cover the Assistant on the insured Harvest combine

bearing No. AP 25 M 6118. Therefore, prayed to allow the appeal setting aside the Order passed by the leamed Commissioner.

The leamed counsel for the applicants contended that though the applicants have proved their case by examining the applicant No.2 as AW.I and by filing Exs.Al ro ,4.6, the leamed Commissioner has awarded very meager compensation. Therefore, prayed to award just and reasonable compensation along with inierest @ 12% per annum from the date ofaccident instead from the date of filing the application.

Admittedly, there is no dispute with regard ro the manner of

accident. However, the leamed Comrnissioner after considering the oral and documentary evidence available on records, rightly hetd that the deceased met with accident on 19.3.2006 during the course and out of his employment as Assistant under the employment of opposite party No.1 and died.

ll. Further the learned Standing Counsel for opposite party No.2-lnsurance Company contended that there was no additional premium paid to cover th€ Assistant on the insured Harvest

combine bearing No. AP 25 M 6118. In support of their contention, RW. I was examined and he deposed that their company issued Ex.B I insurance policy for the Harvester of opposite party No.l and the policy was in folce as on the date of accident and that as per the policy, only driver risk is covered and the seating capacity of the vehicle is also one. RW.l further deposed that the deceased was alleged to be tlavelling as Assistant in the said vehicle, but there is no risk coverage for any other person except driver. Further RW.l deposed that the deceased was travelling as an unauthorized passenger and there is no employeeemployer relationship between the deceased and opposite^party No.l. In the cross-examination, RWI admitted that the policy^is package policy. However, Ex.A6lB I copy of insurance policy discloses that legal liability premium paid covering the risk of employees and the poticy is valid from 2.12.2005 to 1.12.2006.

"The learned counsel for respondents I to 4 did not dispute that premium for covering the risk of each person is Rs.l5/-. It, therefore, necessarily Jbllows that the policy covers only driver and no additional premium covering other employees or coolies was paid. As this category of persons is not covered by the Act policy, the appellant is not liable for the compensation awarded for the death of the deceased.^,'

The leamed Standing Counsel in suppon of his above contentions further relied upon a decision in Divisional Manager, Oriental Insurance Company Limited v. Bathina Srinivasa Rao and another2, rvherein the High Court for the erstwhile State of Andhra Pradesh held as follows:

option either to toke out a polic), to cover the risk of his employees or nol, chose not to take a pclicy covering the risk of his employees in the lorry. {Jnless and until the appellant (insurer) takes up the responsibility to cover the risk of the employees of respondent No.2, question of making it liable to pay any compensation to the employees of the respondent No.2 does not arise."

The learned Standing Counsel further r-elied upon a decision in Dudckula Salabec v. R. Siva Sankar Rcddy and another3,

wherein the High Court for the erstwhile State of Andhra Pradesh held as follows:

" 16. A bare perusal ofsub - section (2) of section 147 of the Act makes it obvious that the coverage of policy is limited to the extent mentioned in clauses (a) and (b) of sub-section (2) of section 147 of the Act only. Therefore, it further implies that a policy has to be necessarily taken if the insured wants coverage of a class or classes of persons. In any event, there must be a contractual obligation in the shape of insurance policy and there must be a specific condition under the policy covering a person or persons like the deceased in the present case. It presupposes and as decided by the Apex Court, in various^judgments, a separate premium has to

be paid for such a person or classes of persons and rhen only. the obligation of indemnification by the insurer does arise.

In this regard, I amfortified by the judgment o"/' the flon'ble Supreme Court in Ramashray Singh v. New lndia Assurance Co.Ltd., 2003 ACJ t550 (SC), wherein it was observed that an insurance policy onty covers the persons or classes of person specified in the policy and the relie.f was denied to the claimants therein from^{the insurer} on the grouncl that there was no payment of premium for a conductor, whose designation was actually Khalasi.

The said observations further make it clear tltat taking a policy by paying premium covering risk or risl<s at discretion of the insured is permissible and the liabiliq' of rhe insured is permissible and the tiabilit.v of the insttrer is only limited to that extent, as was agreed in the policy. "

The leamed Standing Counsel relied upon a decision in Gangala Raju and others v. Rayavarapu Apparao and othersa. wherein the frigh courl ro' the erstwhile state of Andhra pradesh held as follows:

"A perusal of the policy shows that premiutn has been paid only for driver of thc tractor. As the premiunt does not cover the labourers, responden! No.3. insurance company is not liable to pay compensation for the death of the deceased, who was allegedly, a labourer h.avelling in the trailer.^"

Based on the principle laid down in the above said decisions,

leamed Standing Counsel for the opposite party No.2 contended that the Insurance Company is not liable to cover the risk of the deceased without payment of any additional prernium. However, it is to be seen that in Oriental Insurance Company Limited v.

Meena Va riyal and otherss, the Honourable Supreme Court observed as under:

" Uninfluenced by authorities, we find no dfficulty in understanding this provision as one providing that the policy must insure an owner against any liability to a third party caused by or arising out of the use of the vehicle in a public place, and against death or bodily injury to any passenger of a public service vehicle caused by or arising out of the use of vehicle in a public place. The proviso clarifies that the policy shall not be required lo cover an employee of the insured in respect ofbodily injury or death arising out ofand in the course of his employment. Then, an exception is provided to lhe last foregoing to the effect that the policy must coyer a liability arising

under the llorkmen's Compensation Act, tg23 in respeu of the death or bodily injury to an employee who is engaged in driving the vehicle or who serves as a conductor in a public service vehicle or an employee who travels in the vehicle of the employer carrying goods tf it is a goods carriage. Section 149(l ), which casts an obligation on an insurer to salisrt, an award, also speaks only of award in respect of such liability as is requirid to -be covered by a policy under clause (b) of subsection ( I ) o/' Section l4Z (being a liability covered by the terms of the policy). This provision cannot therefore be used to enlarge the littbility if it does not exist in terms of Section 147 of the Acl. 14. The object of the insistence on insurance under Chapter XI of the Act thus seems to be to compulsorily cover the liability relaling to their person or properties of third parties and in respect of emplol'ss5 r.,J- the insured employer, the liability that may arise under the Workmenis Compensatiott Act, 1923 in respect of the driver, the conductor and the ctne carried in a goods vehicle carrying gtods. "

" 15. Though the aftresaid tlecision has been rendered on Section 95(2) of the Motor Vehicles Act, l9i9 but the principle underlT,ing therein t,ill be fullv applicable here also. he must take such a^{policyby makingpayntent of} extra premium and the^{policy should also crtntain} a clause to that effect.^{Howevcr, where the policy} mentions "a policy for Act Liability" or^"Act Liability", the liability of^{the insuranceconlpany} qua the employees as aforesaid^{would not be} unlimited but would be^{|imited to thatarising} under the llorkmen's lct."

and othersT,^{wherein the erstwhileHigh Courtof Andhla Pradesh} held as follows:

"13. In the earlier^judgments, rendered^{by this Court,} referred to above, it^{was proceededon the assumptionthat} the proviso to Section^{147(l) of the M.V. Act would relieve} the owners of^vehicle from^{the obligatiottto take out a} policy, to cover the risk^{towardsdrivers, conductors or} other employees,^{and it is left to their discretionto takeout} such policy, by^{paying extra premium.The importanceof} the phrase "other^{lhan aliability arising under the} ll/orlonen's Compensation Act"^{was not appreciated.The} observations made by^{the Hon'ble SupremeCourt in} Prembai Patel's case [2005(5)^{ALL MR 563 (5.C.)] (supra),} would put at rest, the doubt,^{thatmay exist in this context.} Recently, this Court in^{National Insurance Company} Limited^Vs. D. Sivasankar,^{2006@) ALD 398, explainedthe} purport of sub-section^{(l) of Section147of the M.V. Act, as} under;

"Para-9 :^{The liability, which a policy of insurance is} expected to cover, is^{of three categories' viz., i) the liability} that will be incurred^{by the ownerof a vehicle,in respect of} death or bodily iniury^{or damage to property of a third} party, caused due to the use of the^{vehicle in a public place;}

ii) such liability in respect of a^passenger of a^public service vehicle, and iii)^{the lirtbility arisingout of deathor} bodily injury of a^{personengaged in driving of the vehicle} or other employees,^{depending on lhe category of the} vehicle. A perusal of Section^{147of the M.V. Act makes this,} amply clear..."

"Para-I1 :^The first^{two categories of coverage are} referred to in Section 147(l)(b)fi) and^(ii), in specific^terms. The third type of coverage, namely, the one towards the Drivers and other employees, is to be discerned fiom^the proviso. The proviso indicates that the policy is to per se, cover the liability towards the employees referred to in proviso (il @, (b) and^(c), i.e., Driver of the vehicle, the Conductor of a public transport vehicle or any^other employee in a goods vehicle. The coverage for any employees olher than those, referred to above, is optional and cannot be treated as a requirement under the M.V. Act. The liability arising under the ll/.C. Act, in respect of death or bodily injury towards a Drit er is statutory and mandatory and any basic polic.y would c:over it. The insurer would not be under obligotion to pay any extra premium to cover the liability towards the Driver of the vehicle".

Therejbre, the contention of the appellant, that it is not under obligation to cover the liability arising out of the death or bodily injuries to a cleaner, unless extra premium is paid; cannot be accepted. The vehicle was admittedly a goods carriage, and a cleaner engaged on such vehicle is covered by clause (i)(c) of proviso to Section M7(1) of the M.V. Act. Therefore, no exception can be taken to the order passed by the Commissioner, holding that the 3rd respondent and the appellant herein are jointly and severally' are liable to pa.v- the compensation. ,Yo serious in/irmity /s pointed out, os to the quantum of compensation.^"

Balakrishnan and Anothers, the Apex Court^{hetd as uuder:}

" 2 I. In view of tlrc aforesaid factual position, there is no scintilla of doubt that a^{"comprehensive/package} policy" would cover the liability of the insurer for payment of compensation for the occupant in a car. There is no cavil that an "Act Policy" stands on^a dffirent footing from a^{"Comprehensive/Package} Policy". As the circulars have mode the^{position very} clear and the IRDA, which is presently the statutory authority, has comruanded the insurance contpanies stating that a^{"Comprehensive/Package} Policy" covers the liability, there cannot be any dispute in that regard. We may hasten to clarify that the earlier pronouncements were rendered in respect of the^"Act Policy"^which admittedly cannot cover a third party risk of an occupant in a car. But, if the policy is a^{"Comprehensive/Package} Policy", the liability would be covered. These aspects were not noticed in the case of Bhag,,alal<shmi^(supra) and, therefore, the matter was referred to a larger Bench. We are disposed to think that there is no necessity to refer the present matter to a larger Bench as the IRDA, which is presently the statutory authority, has clarified the position by issuing circulars which have been reproduced in the^judgment by.the Delhi High Court and we have also reproduced the same.^"

In the case on hand, as per Ex.Bl and Ex.A6, the insurance

policy is package policy and the vehicle in the case on hand is Harvester and the deceased was travelling in the vehicle as Assistant. Since the deceased was not an unauthorized passenger

and as the deceased was an employee rendering his services to the opposite party No. I under employee_employer relationship, the contention of the leamed Standing Counsel for the opposi te party No.2 that the policy does not cover the risk of applicant being Assistant, is unsustainable. In view of.the above discussion and considering the principle laid down in the above said authorities, the opposite parry No.2 is liable to indemni$, the opposite paqv No.l i.e., owner of the vehicle.

2t. Coming to the quantum of. compensation, according to AW.l, the deceased worked as Assistant on Haryest combine vehicle bearing Nb. Ap 25 M 6118 under the employment of opposrte party No.I and was getting Rs.5,000/_ per rnonrh apart from bata of Rs.50/_ per day. Whereas opposite party No. I stated that the deceased used to receive Rs.4,500/_ per month. As there is variation of the rvages stated by the applicants and the opposite party No.l and as there is no documenlary evidence ro prove the income of the deceased, the learned Commissioner has taken the income of rhe deceased at Rs.2,476t_ per month by applying the rninimum wages as fixed by the erstwhile Govemment of Andhra

Pradesh vide G.O.Ms.No.S3, L.E.T & F (Lab.lt), d,ated,22.l I .2000, which appears to be very [ess. Hence, considcring the avocation of the deceased as Assistant on Harvester, this Court is inclined to take the income of the deceased at Rs.4,000/- per. month.^.l.hc deceased was aged 22 years, for which the relevant factor applicable is '221.37'. Based on the above discussion, the applicants are entitled for cornpensation, which is calculated as under:

With regard to the interest, as rightly pointed out by the learned counsel for the applicants, as per the decision of the Apex Court in P. Meenaraj vs P. Adigurusamye the rate of interest at l2%o per annum has to be granted from the date of accident. [n view of the above discussion, this Court is of the considered opinion that the rate of interest at l2%o per annum has to be granted from the date of accident till the date ofdeposit.
