But there is no such exemptioo 6or the period thereafter till coming into force of GST regime with effect from 1.7.2017. In the absence of such exemption, petitioner is bound to fumish the C-Forms if it wans to avail concessional rate o[ tax under sub-section (1) o[ Section 8. Since it failed to do so, for whatever reason, thc rigour o[ sub-section (2) of Section 8 comes into play. Mere submission o[ representation cannot confer any right on a dealer to seek waiver of filing C-Forms. Principle of legitimate expectation cannot be invoked in a taxing statute.

That aparg if the petitioner is aggrieved by the orders o[ assessment dated 11.3.2019 and 31.3.2019, petitioner had the remedy under Section 9 (2) of the CST Act read with Section 31 of the VAT Act to filc appeal. In a writ proceeding under Articlc 226 of the Constinrdon of Indra, legality and validiry of the assessment procecdings are not ordinanly cxamincd when thc statute provides for adcquatc ancl efficacious altcrnativc rcrnedy. It is not a casc o[ vtolation of the principlcs of natural justrce or violation oI any law to invoke the writ jurisdicrion in spite o[ having adequatc and efEcacious alrcrnauve remedy.^'fhat apart, thcre cannot be ani' cquitablc consideradon in so fa,r taxation statutcs arc concerned.

For the aforesaid reasons, we do not find any merit in the writ petition. Consequendy, the Wnr Petition is dismissed. However, there shall be oo order as to costs.
