By filing this petition under Article^{226 ofthe} Constitution of India,^{petitioner seeks adirection to'} respondent No.1 to submit the sale^{certificateto} respondent No.2 under the^{provisionsof Securitisationand} Reconstruction of Financial Assets^{and Enforcementof} Securiry Interest Act, 2OO2^(briefly, 'the^{SARFAESI Act'} hereinafter), for registration of the^{same in respect of land} to arl extent of Ac. 1.OO^guntas in^{SurveY No.697 situatedat} Mucherla Village, Hasanparthy Mandal,^Hanamkonda \ District ('schedule property' hereinafter).

Thus, from the^{above it is seen that this Court had} directed^{respondent No.1 to proceed further in the matter} by conlirming^{the sale in favour of the petitioner' But' the}

sarne was made subject to S.A.No.6B of 2O2O filed by the borrower before the Debts Recovery Tribunal I Hyderabad (Tribunal). The Tribunal was requested to decide S.A.No.68 of 2O2O expeditiously.

It is stated that by order dated 05.O4.2021, S.A.No.68 of 2O2O was dismissed by the Tribunal. Against such dismissal, the borrower very belatedly filed an appeai under Section 18 of the SARFAESI Act before the Debts Recovery Appeilate Tribunal, Kolkata, which has been numbered as Appeal (Diarf') No.399 of 2O2t. The delay is -'et^{to be condoned and consequentlythe appeal is yet to be} registered, not to speak of any stay of order dated 05.o4.202t.

In such circumstances, we are of the vieu, that there can be no impediment to the respondents to register the sale certificate issued to the petitioner by respondent No. 1.

7 . Accordingly, we direct respondent No. I Canara Bank, to submit the sale certificate issued in favour of the petitioner in respect of the schedule propertl, to respondent
