Petition under Article 226 of lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent Bank without following due procedure as contemplated under the provisions of the SARFAESI Act and Rules, 2002, and the same came to the knowledge of the applicant, when some persons visited the Schedule Property on 09.07.2021, who demanded the Petitioner to vacate and hand to over the vacant physical possession of the same, as the Respondent alleged to have been issued a possession Notice dated 1110712021 rssued under Section 3(4) of SARFAESI Act, 2002 and they have given a copy of the same and after going with the said notice, the applicant came to know that the respondent Bank initiated the SARFESI proceedings against the Petitioner in respect of the Schedule property, is clear violation of the provision of the SARFAESI Acl, 2002, is highly illegal, arbitrary, unconstitutional, violation of Principles of Natural Justice and in violation of Articles 14 and 300-4 of the Constitution of lndia.
