"2O. According to the Government pleader the land u-r Sy.No. I 14 of Tharlapadu Village falls within rhe buffer zone of the Kawal Tiger Reserve. Schedule - II to G.O.Ms.No.27 Environment, Forests, Science & Technolog, (For.II) Department dt. 10.04.2O 12 mentions that certain forest ranges specified therein in certain specified mandals in Adilabad District form the buffer to the core of Kawai Tiger Reserve. It also discloses that seven compartments comprising an Erea of 13O9.5O hectares of Sathanpalli beat in Khanapur Mandal, Nirmal Forest Division of Adilabad District form part of the buffer zone of Kawal Tiger Reserve, But the said notification does not specifically menrion Survey No.l14 of Tharlapadu Village at a.ll as being part of the buffer zone.21. Since this Court in Wp.No.576 of I996 had categorieally held that the land in Survey No. l 14 does not fc'rm pa-rt of Sathanpalli Forest block, notified vide G.O.Ms.No.579, Forest & Rural Developmenr (For.lll), dt.23.08.1979 and only notified Forest Block :n Adilabaci, Bellampalli, .Iannaram and Nirmat Forest Divisions of Adilabad District were included in the buffer zone to rhe area of Kawal Tiger Reserve (area notified as Kawal Tiger Reserwe) under G.O.Ms.No.27 Environment, Forests, Sciencc & Techrroiogr (For.ll) Department, dt. lO.O4.2O12, the land in Survey No.l14 cannot be said to be part of the buffer zone to the core of Kawal Wildlife Sanctua5l or Kavval Tiger llesene at ali. Therefore, tlle contention o[ learned Governrnent Pleader for Forest tlat the land belongitg to ,.-'petitioners in Survey No.ll4 is deemed to be part ol the bufler zone of Kawal Tiger Reserve, cannot bc countenanced."
