The present appeal is filed against the order and decree dated 25.07.2017 passed in F.C.O.P.No.26 of 2011 on the file of the Judge, Family Court-cum-III Additional District Judge at Warangal. By the impugned Order, the learned Judge has dismissed the F.C.O.P. filed for dissolution of marriage that took place with the respondent on 08.11.2009.

During pendency of the appeal, both the parties have entered into mutual understanding and today they have filed a memorandum of understanding duly signed by both the parties and requested this Court to allow the appeal in terms of the compromise entered between them.

Today the appellant and respondent are present and produced their original Aadhar Cards. They are identified by their respective counsel. When questioned, they have stated that due to the intervention of the well wishers of both the parties, they have compromised the dispute on certain terms enunciated in

memorandum of understanding and they prayed this Court to allow the appeal by dissolving their marriage.

The learned counsel for the husband has handed over the Demand Draft for an amount of Rs.7.00 lakhs was also drawn on Union Bank in favour of the wife, which is paid towards permanent alimony. The wife also undertakes to withdraw all the pending cases filed by her against the husband. She has expressed no objection for allowing the FCA. In such circumstances, we deem it appropriate to dispose of the appeal in terms of the memorandum of understanding.

Accordingly, F.C.A.No.447 of 2017 is allowed of in terms of the understanding entered between the parties. Consequently, the order dated 25.07.2017 passed in F.C.O.P.No.26 of 2011 on the file of the Judge, Family Court-cum-III Addidional District Judge at Warangal is hereby set aside and the F.C.O.P. stands allowed by dissolving the marriage that took place between the parties on 0811-2009. The memorandum of understanding shall form part of this judgment. No order as to costs.

Registry is directed to draft the decree in terms of the compromise and a copy of the memorandum of understanding be appended to the decree.
