Petition under Section 151 of CPC, praying that in the circumstances stated in^the affidavit filed herein, the High Court may be pleased to gr rt a stay of all further^proceedings in O.S. No. 198 of 2022 on the file of III Additional District Judge-Cum-Principal^Family Judge, Malkajgiri District, at Kukatpally, pending disposal of CRP No. 2046 of^{2022, on the} file of the High Cowt.

The Petition coming on for hearing and upon perusing the petition and memorandum of grounds and the order of the High Court dated 16-09-2022 &29.102022 made herein and hearing the arguments of the above mentioned counsels the court made the following.

ORDER:

Learned counsel for the petitioners submits that the notices taken out on respondent Nos.36 and 47 have,been returned with^postal endorsement 'refused'.

In view of the^judgment of the Apex Court in C.C,ALAVI HA,I V/s. PALAPETTY MUHAMMED AND ANOTHERI, the return of^postal envelopes with^postal endorsement is deemed to be served.

Insofar as respondents Nos.4, 11, 37, 54 and 60 are concerned, learned counsel for the petitioners submits that they are in receipt of notices and the postal acknowledgments of service of the notices have been filed into this Court through Memo.

It is further submitted that respondent Nos.s to 10 and 12 to 31 are represented by respondent No,11-General Power Attorney, and therefore, the notices taken out on them have been served on respondent No.11- GPA.

As regards notices taken out on respondent Nos.3, 39, 40, 56, 57, 58 and 59 are concerned, the same were returned with^postal endorsemenb'no such addressee/addressee left without intimation/not claimed etc.'

It is also submitted by the learned counsel for the petitioners that notices could not be served on respondent Nos.32 to 35, 38 and 55.

In view of the said submission, learned counsel for the^petitioners is^permitted to file a better application seeking to effect service through substituted mode by way of^paper publication, in respect of the respondents who have not been served.
