The appeal has been^preferred by Oriental Insurance Company Li.mitird through il.s Manager, who is shown as 2nd opposite prrty in E.C.No.l23 of 2018 on the file of Commissioner for Employr:r:s Compensation and Deputy Commissioner of Labour-1, Hydt:rabad.

Beincl aggrieved by the order passed by the learned Commissioner lr the above re'erred E.C. dated 03-01-2022, the Insurance Company has^prefe rred the appeal on the following grounds:

The learned Comrnissioner failed to see that the respondent No.1 i.e., applicant in the E.C. did not produce any driving license tc show that he was authorized to drive the insured vehicle. The do:uments file I r)y him clearly indicates that he did not produce any such driving license and the police charged him under Section 131 of Motor Vehicles Act in addition to the Penal provision, theft:by, it is q rlte clear that the respondent No.1/claimant hi s no drivinct license.

The appellant claims that when there is no license and no^particulars provided, the insurance company could not be expected to veriFy from all the RTA authorities regarding driving license of the claimant. But learned Commissioner erred in drawing an adverse inference against the appellant and passing an award. The appellant further pleaded that there was no document filed by the respondent No.1 to show that he was working as driver of the insured i.e., l't opposite party. The learned Commissioner committed an error by assessing the loss of earning capacity of respondent No.1 as 100%. The Doctor did not assess the loss of earning capacity keeping in view the injuries specified in schedule II of Employees Compensation Act, thereby, the appellant sought for setting aside the award.

As could be seen from the record, E.C.No.123 of 2018 has been filed by respondent No.1/applicant against the appellant herein and also one V.Venkataiah, owner of the lorry bearing No.TS 12UB 4173. According to the averments made in the said case, he has claimed that he worked as driver on the^lorry of the 1't opposite party, thereby, he was a workman within the meaning of the Employees Compensation Act. On 04-01-2018,^{he wason} duty as driver on the above said lorry. He was^{proceeding from} Hyderabad towards Sagar road and at about 1.00 a.m., when^he reached Peddavoora centre, he lost control over the vehicle and

dashed the auto-rickshaw which was^parked on^{the road, thereby,} he suffered injuries. The respondent No.1 has submitted that^he suffered polytratrma crush syndrome with deranged^parameters apart from other injuries ano while claiming that he used to draw Rs.15,000/- per month as his salary apart from Rs.150/- daily batha, he has sought for a sum of Rs.6,00,000/- towards compensation. lhe owner of the vehicle, who was shown as 1't opposite party remained ex parte. The appellant herein, who was shown as 2niopposite party filed counter and disputed all the material averments including the alleged employer and employee relation between claimant and 1't opposite party. The appellant has disputed the claim of respondent No.l/claimant that he was receiving Rs.15,000/- per month as his salary etc.

6, The appellant further pleaded before the learned Commissioner tl-at the respondent No,1 herein was unable to produce any driving license, it shows that he has no driving license, but drove the lorry, it amounts to violation of the policy condition as such, sought For dismissal of the application. 7. The l:arned Commissioner framed four (4) issues for enquiry. In the enquiry, the respondent No.1/claimant himself was examined as AW.1. He has examined one Dr. A.Srinivas Goud as AW.2, D.Hari:;h, an employee from Srikara Hospital as AW.3 and Billing incharge of Virinchi Hospital, Hyderabad as AW.4. He

has marked Exs.A1 to 415. The respondents in the said case i.e., owner of the vehicle and insurance company did not produce any oral evidence but marked the true copy of insurance policy as Ex.81.

B. I have heard both parties.

The learned counsel for the appellant has submitted that the record placed by the respondent/claimant clearly shows he was not having a license thereby, charge sheet was filed under Section 18 1 of Motor Vehicles Act. The insurance company cannot search the entire country to find out whether the respondent No.1 has got driving license, he is under an obligation to establish that he possessed valid license and in the absence of such proof, it amounts to violation of the conditions of the policy. The I't opposite party is expected to verify before handing over the vehicle whether the driver has got a valid driving license. In view of the above^proof that respondent No.1 was not having license, the insurance company is not liable to pay any compensation.

The learned counsel for the respondent No.1/claimant submitted that simply because the police filed charge sheet under Section 181 oF Motor Vehicles Act, it is not a conclusive^proof that the driver has no valid license. As per the record, when the investigating officer asked the respondent No.1 for his license, he could not have produced but there is no other proof to believe that

the respondent N(,.1. did not^possess license. Therefore,^{he sought} for dismissal of th : appeal.

Now the point for consideration is :

.ryhether the 1sr respondent/claimant had no driving license, thereby the appellant herein is not liable to^pay any comper sation?

The present appeal is filed mainly on the ground that the respondent Nc.l/claimant did not possess a valid license. To substantiate their contention, the learned counsel for the appellant placed reliance on the copy of charge sheet wherein, it is stated that the respondent No.1 committed an offence under Section 181 of Motor Vehicles Act as he was not in possession of the driving license. Investigating Officer, who said to have conducted investigation in Crime No.4 of 2018 which was registered soon after the accident, was not exa mined before the learned Commissioner. l-+e was not cross-examined to elicit what efforts he has done for verifying the license of the respondent No.1.

The learned Commissioner before whom this issue was raised categorically found in para No.26 of the order that though it is stated in the charge sheet that respondent No.1 committed an offence under Se,:tion 181 of Motor Vehicles Act, it was not the case of police that the applicant did not possess any driving license. Since he was unable to produce the license when he was

produced before the Court, the police have added Section 181 of Motor Vehicles Act In addition to Section 337 of I.p.C. The 1't opposite party i.e., owner of the lorry might not have entrusted such a big vehicle to a driver who was not possessing license. He must be aware of the consequences of handing over the vehicle to a person without having valid license. Except the allegation in the charge sheet, no other proof is placed to believe that the respondent No.1 did not possess license.

The learned counsel for the appellant has relied on a Judgment between "Oriental Insurance Company Limited v. Premlatha Shukla and othersl, wherein, it was observed that "where the accident occurs owing to rash and negligent driving by the driver of the vehicle, resulting in sufferance of injury or death by a third party, the driver would be liable to pay compensation therefore. Owner of the vehicle in terms of the Act also becomes liable under 1998 Act. In the event vehicle is insured, which in the case of a third party, having regard to sub-Section (2) of Section 147 of the Act, is mandatory in character, the insurance company would statutorily be enjoyed to indemnify the owner. The insurer, however, would be liable to reimburse insured to the extent. However, the factum of accident could also been^proved from the First Information Report. the contents of the document^is admitted in^evidence, the^party bringing the sarne on record cannot be^permitted to turn^around and contend that the other contents contained in the rest^part thereof had not been proved.

Both parties have relied on the documents marked during the enquiry. The learned counsel relied on another ludgment betwr:en M/s.Oriental Insurance Company Limited vs. Thiru R P Manjukuma12, for the proposition that when the insurance company raised a plea that the driver of the vehicle does not possess valid driving license at the time of accident, it is for the owner of the vehicle to prove that at the time of accident, the driver had valid driving license to drive the vehicle either by producing the c,riginal or photo copy of the same at the time of trial before the Court. It appears from the above^judgment that a notice was issued to the owner of the vehicle inspite of it to produce the driving license, he did not produce the license.

The learned counsel further relied on a Judgment between "Beli Ram vs. Rajinder Kumar and Anr3", argued that when the driver failed to renerry the license for a period of 3 years that too in rescect of commercial vehicle, the employer cannot wash his hand:; of responsrb lity of not taking up whether the

driver has renewed license and insurance company is liable to pay compensation.

The learned counsel for the respondent placed reliance on a Judgment between "The United India Insurance Company Limited vs. Smt.P.Shyamala & 3 Orsa,.wherein, the Judgment between "Beli Ram vs. Rajinder Kumar and Anr." was also discussed and argued that in this particular case, insurance company failed to prove that the respondent No.1 has no license and^. simpty because the owner failed to cross-examine the insurance company it cannot escape the payment of compensation. In the Judgment relied on by the respondent/claimant, this Court made an observation that even if there is violation of the conditions oF the policy, the insurer company is liable to pay compensation and recover the same from the owner of the vehicle. In the present case except an allegation in the charge sheet, there is no^proof that respondent No.1 had no driving license. As I have already observed allegations in the charge sheet which were not^proved through any evidence cannot be a basis for holding that the driver had no license. Therefore, on that ground, the insurance company cannot avoid the^payment of compensation. Therefore, the appeal is not maintainable.
