cash credit Iimit of Rs.3,70,00,000/- vide Credit Loan Account No.3972008700000488 from the respondent Bank by creating security interest over the petition schedule 'A' & 'B' properties. Due to slowdown of the market, the clientele of the petitioners could not pay bills to them promptly which resulted in irregular maintenance of the aforementioned Credit Loan Account by the petitioners. All of a sudden, the respondent Bank declared the 1't petitioner firm as NPA on 29.77.20L9. Though the 1't petitioner firm made every effort to satisFy the respondent Bank to consider its case, the respondent Bank did not heed to the said request and filed Crl.M.P.No.2B9 ot 2020 under Section 14(1) & (2) of Securitlzation and Reconstruction oF Financial Assets and Enforcement of Security Interest Act, 2002, before the Chief lvletropolitan lVagistrate, Cyberabad at L.B.Nagar and obtained a Commissioner's Warrant to take possession of the secured assets. in Fact, the Schedule 'A' property mentioned in the subject Commissioner's Warrant does not belong to the petitioners and they have nothing to do with the same. The 4th respondent has approached the learned ChieF Metropolitan Magistrate, Cyberabad at L.B.Nagar with unclean hands. The impugned Commissioner's Warrant, dated 15.12.2020 is bad in law and unwarranted and ultimately prayed to set aside the same and allow the writ petition.
