Petition under Article 226 of lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to pass an order, direction, writ in the nature of mandamus duly declaring the aclion of the^'lst respondent in resolving the matter in CMA number 20 ot 2011 without affording any opportunity for the petitioners to prosecute the same due to the reason of the death of their counsel, as illegal arbitrary and against the principles of natural justice and consequently direct the 1" respondent herein to reopen the CMA 20 of 2011 and provide the opportunity for the petitioner's to prosecute the same by duly punishing them the entire record in the above CMA in the interest of justice

Heard learned counsel for the^petitioners and^learned Government Pleader. With their^{consent, the writ petitionis} disposed of at the stage of admission.

Learned counsel for the peitioners would submit that the person who represented before the 1st respondent has^passed away due to Carona as such the^petitioners have^{not pursued the matter} and now the same was reserved for orders. In that scenario, the present writ petition is said to be fi1ed.

On perusal of the record, this Court finds that there is no proof of document or any efforts were made by the qlitioners sensitising the 1"t respondent with the facts that have taken^place. Hence, there shall be a direction to the^petitioners to approach the lst resondent and file appropriate application within one week from the date of receipt of a copy of this order and the lst respondent shall consider the application filed by the petitioners in accordance with law as expeditiously as possible.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.
