Regard being had to the controversy involved in the aforesaid cases, they were heard together and are being decided by a common order.

The facts of W.P.No.24 135 of 2OO9 are reproduced as under:

The present writ petition i.e., W.p.No.24 135 of 2009 has been filed by the petitioners, who are residing at Nagarjuna Nagar, 'Iarnaka, stating that the private respondents have encroached the land, which is earmarked for park. Various grounds have been raised in the writ petition and a detailed aflidavit has been liled by the Greater Hyderabad Municipal Corporation (for short, "the GHMC,,). The private respondents before this Court has stated that the land in question is certainly not a park keeping in view tine Zilla parishad layout dated 07.O2.1978.

The affidavit filed by the GHMC revea,ls that the so_ calledZilla Parishad layout pe;mit No.13, dated 07.02.197g is illegal since it uras created after the DTCp layout approval in 1 968. It has been further stated that as per the DTCp comprehensive layout pertainirrg to Sy.Nos. 166, 16T and 168, which was approved by the Director of Town and Country

Planning vid,, permit No.1 of 65, dated ll.Ol.196Z , there was 3000 square yards shown towards the proposed open space. In Sy.No.168 an extent of 600 square yards r,r'as earmarked as open space i r front of plot Nos.9 to 11. It has been further stated that ir L spite of several artempts to illegalll. occupy the open space, t he vlgilar-rce of thr: colonr, r.i'elfare association has successfully ;afeguarded this open space rvhereas the rest of the open s1 ace of 2400 square yarcisr has already been encroached rpon and constructions have taken pJace long back. The affidavit further reveals that the private respondentsT K. Srinivasa Rao and S. Srinivas Reddy created some docum :nts in order to grab the park lan<I by showing fake Zilla Pa: ishad layout. lt has been stated that once the DTCP layout was approved. the Zilla parishad iavout can never be stat,:d to be a valid lalrout.

In thos: circumstances, Sri pasham Krishna Reddy, learned Gove'nment Advocate appearing for the GHMC, has stated before this Court that tire GHMC may be permitted to construct the wall in respect of the land, r.r,l,rich is earmarked for park, and to develop the par.k.

This Co rrt in the light of the aforesaid affidavit, as the open area is earmarked as park under the DTCp layout, which was ap proved way back in 1968, is of the opinion that the same sp. rce has to be protected and the GHMC shall certainly be^j ree to fence the area/ to construct the wal1 to develop it as 1 ,ark. So far as the remaining area is concerned,

the DTCP, in case there are encroachers, sha1l be free to evict the encroachers by follou,ing due process of law. The exercise of removing the encroachers and taking possession of the entire area after following due process of law and constructing the boundary wall be completed within a period of three months from today with an intimation to the Registrar (Judicia-l) of this Court.

With the aforesaid, all the writ petitions are disposed of.
