The facts of^{W.P.No.l5497 of 2016, from which} W.A.No.319 of 2O2I arises,^{are beingdealt with to decide} first batch of cases.^{.The facts of the case reveal that the} writ petitioners were^{in physical possessionof the land in} question. After coming into^{force of the TelanganaAbolition} of Inams Act, 1955,^{the writ petitioners, who were} protected tenants, became^{pattadarsof the subject lands} by virtue of 38-E^{Certificategranted by the Revenue} Divisional Officer,^{Hyderabad. The lands were sold by the} predecessor-in-title and^{varioussale deeds have taken} place from time to time.^{The ORCs were granted in the year} 2005 and without^{granting any opportunityof hearing to} the petitioners or to^{the predecessors-in-title, the ORCs} were cancelled^{by order dated 25.02'2006 passed by the} Joint Collector.

The facts of^{the case further reveal that a Notifrcation} was issued on 09.02'^{1989 by the Wakf Board in exerciseof} powers conferred under the^{Wakf Act, 1954 read with Wakf} Amendment Act,^{1984 declaring the lands including the} aforesaid lands in^{MamidipaliiVillageas wakf lands'The} undisputed facts further^{reveal that ORCs were granted in} favour of petitioners^{keeping in view the Abolition of Inaras}

Act, L955 and^{it was set aside by ttre Joint Collector in} Appeal withou^{granting any opportunity of hearing to the} petitioners. T re^{undisputed facts further reveal that} genesis on the basis^{of which the Order was passed by the} Joint Collector^{is based on Notification dated 09'02'1989} issued by the^{Wakf Board declaringthe lalds as wakf} landsandearji'eralsothesameNotificationwassubjected to^judicialscr ltiny^{before this Court' The learnedSingle} Judge has all^{rwed the writ petitions on the ground that} earlier also sa^{ne Notification was declaredby this Courta} nullity in W.I.No.9378^{of 2009 decided on 06'02'2012'} against^wh ich^{Writ Appeal was} preferred i.e., W.A.No.1(^{10 of 2Ol2 and' the same was also dismissed} on 07. 1 1.201:^.

In the^{co rsidered opinionof this Court, keepingin} view the^hi ;tory^{ofearlier litigation, oncethe} Notif,ication d^{rted 09'02.1989 itself has been held as} inva-lid, unsu;tainable^{and was set aside'the} 'Ioint Collector coul'I^{not have passedthe order granting ORC} in favour of tt^{e Wakf Board and therefore, this Court is} of the opinic^{a that the Order passed by the Joint} Collector beh:^{nd the back of the petitionersbasedon} the Notificatir n^{dated 09.02.1989, which was held in} I \the^{earlierror Lnd of litigation as bad in law, has rightly}

been set aside by the learned Single Judge and^{in those} circumstances, the learned Single Judge was^justified in allowing the writ petitions.

The Joint Collector has set aside the ORCs without putting the parties on a notice and without affording them an opportunity of hearing and therefore the learned Single Judge has rightly remanded the matter back to the Joint Collector and a liberty has also been^granted to the^Wakf Board to implead itself and to^produce any other material besides Notilication dated 09.02.1989. The^{parties before} this Court will certainly have a right to argue^their respective cases before the Joint Collector and they^shall be free to produce any material in respect of their^claims and the Joint Collector shall certainly be^{free to decide the} matter in accordance with 1aw keeping in view^various Judgments delivered by this Court and the statutory provisions governing the fie1d.

In respect of second batch of writ petitions, i.e., W.P.No.20425 of 2009 and other connected matters, writ petitions have been filed challenging the Notifrcation, dated 09.02.1989. The facts in W.P.No.2O425 of 2009, from which Writ Appeal No.318 of 2021 is arising, are being deallwith. The facts of the case revea-l that the

Notihcation^{dr,ted 09.02.1989 issued by the Wakl Board} declaring the^{land in Survey No'253 to the extent of} Acs.0.20^gu rtas^{situated atMamidipallyVillage'} Saroornagar^{I levenue Mandal, Ranga Reddy District as} wakf land. Th^{: petitionercontended before this Court that} one Smt. S.I 'S.^{Gowri purchasedthe land from one} Peromoni Kon Laraiah^{under a registered sale deed dated} 23.06.1989.^{S rbsequently, Smt. S'P'S' Gowri sold the land} to the^{petitior:er vide sale deed dated 13'03'2008 and the} document^wE s^{presented for registrationunder the} provisions of t re Registration^{Act on 13'03'2008'However'} the Sub Reg strar,^{Champapet, Ranga Reddy District} (West) in spit': of repeated^{requests, did not registerthe} aforesaid docr'^{ment. register the document on the^ground that^{the property is a} wakf property keeping in^view the^{Notihcation dated} Og.O2.1989. It is pertinent to note^{that in another writ} petition, i.e., W.P.No.9378 of 2009, by an^{order dated} O7.O9.2OO9, this Court has directed^{the Sub Registrarto} register the sale deed, which^{was also not being registered} on account of Notification,^{dated 09.02.1989 and it was} also observed that the^{registration shall be subject to} result of the writ^{petition. The writ petitioner, thereafter,} has preferred the^{present writ petitionNo'20425of 2009} praying for issuance of an order^{directingthe Sub Registrar} to register the^property and^{also for declaring the} Notification, dated 09.02.1989^{as arbitrary and opposed to} iaw. Thus, in short, in the^{second batch of writ petitions,} the Notification, dated^{09.02.1989 issued by the Wakf} Board declaring the subject^{lands as wakf lands is under} challenge.

The learned Single^{Judge has dealt with the} Nodfication, dated 09.02.1989^{issued by the Wakf Board} d.eclaring the lands as^{wakf lands. The relevant frndings of} the order passed by the^{learnedSingle Judge which deals} with the Notification dated^{09'02.1989 is reproduced as} under:-

A earned Single^{Judge of thisCourt' in} W.P.No.25Ol 6^{of 2OO4,vide order,dated19 04'2012' at para} 4, while dea..ng^{with the same issue, has observed as under:} "..... the i npugned^{Gazette notification,} dated 17.10.2002, does not^{I tand to scrutiny in the eye} of law as it rs^a notification issued^{undera repealedenactment'this Courtcan} only say th rt^{the said notification published in the Gazetteis a} deadwood.'

Anc lher learned^{Single Judge of this Court'in} W.P.No.196 I^{ol2012, vide order, dated 22'03'2016'} observed as^under:

'Th: s Court^{consideredthesimilar issue in} W.P.No.2S )76 of^{2OO4 relied on by the learned Counsel for the} petitioners and wherein,^{this Court quashed the notiflcation} under Act of^{1954 on the ground that Wakf Act'' 1954 is} repealed ry Section^{112(1) of the Wakf Act,1995,and} notifrcatio; r^{published inthe Gazette does not stand to} scrutiny il the^{eye of 1aw,as it is a notihcationissued undera} repealed :nactment.^{Inthis case also, admittedly the} impugned notification is^{also issued under Act of 1954 is} repealed t^y the^{present Act. Since the order in the said wdt} a.-r petition h,.s become hnal and^{Wakf Board is a party to it, the}

present issue is squarely covered by the^judgment of W.P.No.2074 of 2004....'

While dealing with the validity of the impugned Gazette Notification No.46-A, dated 15.1 1.2OO1, issued^by the State under the^provisions of the Wakf Act,^{1954, which} has been repealed by the Wakf Act, 1995, this Court in W.P.No.33 133 of 2014, by order, dated 22.O9.2O16, held as under:

"45. In view of the rival^{submissions,it isfrrst} necessary to consider whether the conduct of survey^{by a} Survey Commissioner during the time when^{the WakfAct,} 1954 was in force, without^publication of the same in^the Gazette under sub-Section(2) of Section 5 of the said Act, conferred any right on the 2na respondent or not. If the answer is !es', then such right is^saved under sub-Section⁽²⁾ of Section l12 and not othenvile.

This issue was considered in TAMIL NADU^WAI(F BOARD v. IIATHIJA AMMAL (DEAD) BY L.Rs. Etc.^(AIR 2OO2 SC 4O2). ln that case also a survey^{was madeby the} Survey Commissioner constittlted under^{the WakfAct, 1954} determining that a^{particularpropertyis wakf property, but} no Gazette Notification had been^{issuedunder Sub-section(2)} of Section 5 of the Act. Sults rvere filed by the appellant^before the Supreme Court for recovery of^{properties,futuremesne} prohts and costs. The Trial Court held that though the property in question is a public wakf, the notification, dated 24.12.1958, issued under Scction 5(2) of the^Act did^not include it and so the appellant cannot recover^possessionof the property. This u,as afhrmed in First Appeal. The First Appellate Court held that in the absence of proper notification under Sub-section (2) of Section 5 of the Act that the suit properties are wakf properties, the appellant cannot succeed in the suit for recovery of possession. The High Court affirmed the same in the Second Appeal. The Supreme Court held that if any property is not published as wakf property as required under Section 5(2) to Act, the Wakf Board cannot file a suit for declaration and possession. It observed that if any !^{propertV hasbeenomittedform a notification,the Wakf Board} 1^{may itself collect informationregardingany propertyds} -.

provided unler^{Section27 of tineWakf Act' 1954 and decide} whether^{pal jcular propertyis wakf propertyor not and that} decision is^{inal unless it is revoked or modified by a Civil} Court, but^{t ris course of action had also not been adoptedby} the Wakf^{B< ard in that case. lt held that before hling the suit} for recovery^{of possession as providedin law' the Wakf Board} should har e^{followed the procedure as required under} Sections 4,^{5 and 6 or 27 of the Wakf Act' 1954 If the suit} properties a^'e not^{included in the notification published under} Sub-section^{(2) of Section 5 of the Act, steps should have been} taken as^{p:ovidedunderSection27 ol the Act and only} thereaJter a^{suit for possession could have been frledand not} otherwise. It^{therefore affirmedthe decisions of the Courts} below.

n view^{of this clecision, I reject the contention of} the 2'd^{re pondent that the suweyreport of the Sun'ey} Commissio:.er^{preparedin 1963 under the WzrkfAct' 1954 is} a complete( action^{which is deemed to havebeen saved under} the deemin ;^{clause in Sub-section (2) of Section 112 of the} Wakf Act, 1995.^{It is clearlyan inchoateact and nota} complete^{a :t and cannot be treatedas something "done"or} action "tak^{:n" under the Wakf Act, 1954' It wouldhave been} complete^r nly^{or treatedas something udone" or action} "taken',^{or ly if there had been a Gazelte Noti{icatron under} Sub-sectior^{(2) of Section 5 of the Wald Act' 1954'} 49. Consequently,^{the principlelaid downin} D.C.BIIAT}^{A ANDOTHERSv' UNIONOF INDIA (UOI)AND} ANOTHER^{(1995)1 SCC1O4) would apply i e} '^{the provisions} of a repea.l:d^{statute cannotbe relied upon after it has been} repelead^e rd^{thoughwhat has beenacquired underthe} Repealed ..ct^{cannot be disturbed' ifany further stepis} needed to^{be taken under the Act (such as pr"rblication of} Gazette^{Nc jhcationunderSub-section(2) of Section 5 of the} Wakf Act,^{1954), that cannot be taken after the Wakf Act''-} -- 1954 is^re1 elead^{by the Wal<fAct, 1995'}

Second Proviso to.Sub-section (1) of Section 4 of the AP (Telangana Area) Abolition of Inams Act, 1955, no doubt states that if any person other than charitable or religions institutions has. been registered as an occupant under Sections 5 to 8 after the commencement of the AP (Telanga-na Area) Abolition of Inams (Amendment) Act, 1985, such registration shall and shall be deemed always to have been null and void and no effect shall be given to such registration. The proviso was introduced by the AP Act 19 of 1994 with effect from 26.L2.1985.

Second proviso to Section 4 was introduced by the AP Act 19 of 1994 with effect from 26.12.1985. For this to operate in respect of the subject land, a valid Gazette Notification must already have been issued under Sub-section 92) of Section 5 of the Wakf Act, 1954 or Sub-section (2) of Section 5 of the Wakf Act, 1995. Only then it would be impressed with the character of "wakf property" as held in Tamll Nadu Wakf Board's case (supra) referred to above.

It is not the case of the 2"d respondent that the property in question became wakf property on account of permanent dedication by any.person professing Islam. The sole basis of the claim of the 2"d respondent that subject property is a wakf property is that it was included in the Survey report of the Survey Commissioner prepared in 1963 under the Wakf Act, 1954."

This Court in B.Gowra Reddg us, Gouernment o.f Andhra Prqdeshl while dealing with the very same notilication, dated 09.02.1989, at paragraph Nos.26, 29, 32 and 33 has held as under:

"26. A survey of various decisions referred to above would led to two issues, which have to be considered by this Court, viz., whether there was a contravention of the provision of Sections 4 to 6 of the Act and whether the writ petitions are maintainable under Article 226 of the Constitution of India.

The pre-requisite for publishing tJ"e Wakf is an enquiry to be conducted under Section 4 of the Act aJId such an enquiry report has to' be forwarded to the State Government, who in turn has to forward the same to the Wakf

It is true^{that under Section 83 of the Act any} dispute ar sing^{out of Wakf propertiescan be agitatedonly} before the Tribunal^{constituted under the ActBut, in the} instant ca;es, the^{very principal requirementof noticeand} conductinl enquiry^{as envisaged under the Act are lacking'} Therefore, the^{question of driving the petitioners to the} Tribunal r ould^{not arise. Admittedly, the petitionershave} made ou their^{occupationrights from Mr'Rangaiah's} possessior and thereafter,^{Mr.Lakshmaiahand theyhave} purchased the land under^{registered sale deeds and that too} after obta ring^{appropriatcpermissionfrom the Competent} Authority and it^{is also one of the contentions of the} petitioners that they^{have acquiredtitle byadverse} possessior. But, I am^{not inclined to adjudicate the same} inasmuch as I am^{only concerned with the validityof the} notificatior^{published inthe Gazetteon 9 '2'1989'The} decision r,ferred^{to by the learned Counsel for Wakf Board} that t1:e^p titioner^{have to approachthe Tribunal or the Civil} Court, as ]re^{case maybe, even after the expiry of one year} period a-ft :r the^{publication of Gazette notification is not} applicable^{to the presentcases,as that situation wouldnot} arise inas^{nuch as when the noticeitselfis lackingand no} purpose v 'll be served^{by approaching the Tribunal' or Civil} Court. lt^{is a.lsoto be notedthat the reportof the Survey} Commissi, ner^{sent by the Government to the Wakf Boardhas} no autom rtic^{acceptance. It is required to examine such} report bef^{,re publishing the listThis statutory obligationis} also total y lacking^{in this caseWhen the violationof} statutory :rovisions^{is made out, it is alw'lys open to the} pa,rties tc approach this^{Court under Article 226 of the} Constituti )n of India.^{Aclmittedly,as can be seenfrom}

v.rious documents frled by both the Parties^{in these matters,} nothing has been established to^{sustain the contention tttat} the enquiry was conducted as required under Section 4(3) of the Act. In such a situation, it cannot be said that^the impugned Notification is binding on the^{petitionersand} accordingly, the petitioners are entitled to challenge the^same as it is illegal and not enforceable as far as^{petitionersare} concerned. Accordinlly, I have to reject the contention^raised on behalf of the Wakf Board and also the Government^{in this} regard.

It is also to be noted in this regard that though the Wakf Board has been contending that the^{property in} question is a Wakf property, which was notified in the Ofltcial Gazette as early as in 1989, but it is surprising to note^that till today no action has been initiated either^{for evictingthe} petitioners or for recovery of possession of the Wakf^property and no proceedings were initiated before the^Tribuna.l constituted under the Act. None of the revenue^recordseven whisper about the Property as belonging to^{Wakf Board. It} appears that the Wakf Board has frled an appeal^onlyagainst the order of granting occupancy rights^{to the petitioners,ald} that too after one year and half decades^{which is pending} before tJ.e appellate authority on which I am^{not inclinedto} make any comments, Under these^{circumstances,I haveto} necessarily hold that the notification^{publishedby the Wakf} Board in the Gazette on 09.02.1989 is^{not valid and the same} is not binding on ttre^{petitioners. Accordingly, it is set aside} as far as the petitioners are concerned.^{So far as the relieffor} quashing the proceedings^pending before the^appellate authority under the Inams^{Abolition Act is concerned,I am} not inclined to do so.^lt is^{open for the parties to agitatetheir} respective rights before the appropriate^authority."

"From this, it is clear that a detailed^{surveyis required} to be conducted. The^{publication of the notification must be} soon, though not immediate, a-fter the survey. The reason^is that, any events, that occur between the^{date of survey, and} date of publication of the notification^{would renderthe very} exercise futile. If any substantial development^takesplace between the two events, the survey conducted^{earliercannot} at all constitute thd basis for^{publication.Evenotherwise,} unreasonable delay would defeat the very^objective, underlying the provision.

It was way back in the^year 1960, that the^{survey in} respect of the land in Sy.Nos.299 to^{306 of Mamidipally} village was conducted under Section^{4 of the WakfAct' 1954.} The publication rvas made only in the^year 1989.^{In the} period of three decades, that has intervened,^several legislative and administrative changes^{have taken place. The} Inams Act came into force, and in the^{courseof its} implementation, the ORCs^{were granted in respect of the} lands. Had any survey been^{conductedimmediately} preceding the publication in the year 1989, the fact^{that the} petitioners or their predecessor;s in title had in^{possessionand} enjoyment of the property, as absolute^{ownersor were issued} ORCs; could have been^{noticed, and issuance of notification} would certainly have become doubtful.^{By no stretchof} imagination, the survey conducted^{in the year 1960 can be} said to be the basis for^{publicationof a notificationin the year} 1989. Therefore, the notifrcation^{dated 09.02.1989 cannot be} said to be inconformity with the^{provisionsof the Wakf Act.}

This Court, in B.Gowra Reddy's case^{(sura)dealt with} the manner in which the notification^{underchallenge herein} was issued, and expressed the^{view that} it^{doesnot accord} with law. The principle laid doum therein covers the facts^of this case also.

The third contention arises on account of the objection raised by the 2.d respondent, the effect that the^petitioners cannot challenge the notification at this stage, when^{its right} to file a suit under the Act is barred.

The question as to u,hether the limitation and other aspects covered by Section 4 to 6 of the Wakf Act would apply in relation to proceedings initiated by third^parties also,^was 'dealt^{with by the Hon'ble SupremeCourt in Board of Muslim}

RadhaKishan ll979l 2 SCC468)' lt u'as} held that tt :^{notifrcation wouldbecomefina'l and conclusive} as between^{the Wakf Board and the Mutawalli' on t].e one} hand, and^{t he persons interested in the wakf' on the other'} but not^{age inst the persons, who are not interestedin the} wakf. The I etitioners^{herein did not claim any interest in the} wa-kI concer^.ted.

Recent y whiie^{dealing with the lands insurvey} Nos.302 anc^{3O3 of the verysamevillage'this Court in} W.P.No. 1442 of^{2O2O,vide order dated 11'022020'relying} on the^{judgn ent of the learned Single Judge in W'P'No'9378} of. 2OO9, dat:d'^{06.02.2012, whiledealing with the lands in} survey Nos.3^{12 and 303 of Mamidipallyvillage' has held as} under:

In view of the law laid down by this Court as^{well as} the Hon'ble Supreme Court in the above referred^judgments, this Court is of the opinion that the notilication,^dated 09.02.1989, issued by the Waqf Board is one without jurisdiction and the same is liable to be set aside. Accordingly the second batch of writ^{petitions are allowed} and the notification dated 09.02.1989, is set aside.

Coming to the first batch of writ petitions^filed questioning the order of the Joint Collector, the operative portion of the impugned order dated 25.02.2006 setting aside the orders of the RDO reads as under:

".... Ihrr" it is evident^{that the saidlands are Waqf} lands and grant of Occupancy Rights Certificate to^individuals in respect of WaJ<f lands is not in order.

No individual is enritled to^get any Occupancy^Rights Certificate on such land and religious institution^{alone is} entitled to get Occupancy Rights Certificate.^{Hence the} Occupancy Rights Certificate issued by the^Revenue Divisional Officer Ranga Reddy East Division in^{File No.(l)} Jl4163/1986 dated 7-1-2005 l2l J1416211986^dated7-i- 2005⁽³⁾ Jl4164l1986 dated 7-1-2005 &\Jl4t65ll986^dated 7-|-2OOS are set aside and the Revenue Divisional^Ofhceris directed to issue Occupancy Rights Certiflcate^{in the nameof} religious institutions only in light of the above amended^Act No.19 of 1994....."

A perusal of the above portion reveals that the Joint collector has suo mofo taken up the issue and while setting aside the orders of the RDO has granted ORC in favour of the Waqf Board, solely based on the Gazette Notification dated 09.02. i989. Neither the material on record nor the counters filed before this Court reveal that either the legal representatives of the Inamdars or the persons, in whose favour the RDO has granted ORCs, were put on notice nor given an opportunity of hearing with rcgard to the suo moto taking up of the case or that reliance was being placed on the Gazette Not.ihcation dated 09.02.1989 while passing the order, dated 25.02.2006. This Court as well as the Hon'ble_._

Supreme Co rrt in^{catenaof caseshave held that the} principles of oatural^{justice are inviolableand fundamental} to the rights ;f^{the parties to be heard before any orders are} passed and t le Courts^{under Article226 of t]ne Constitution} of India can exercise^{judicial power to reviervthe decisions} made by the^{subordinates/ quasijudicialauthorities to see} whether the rrinciples^{of natural justice are violatedor not} and wheneve u'arranted^{the Courtrvill step-in to correctthe} same. The^{p,,wer of judicialrevierv has been held to formthe} basic structl Lre of the^{Constitutionand the said power} cannot be co^{rtrolledor exclucledby any provisionof Statute} or Rules ma( e^{thereunder.Therefore,the contentior-rof the} learned Stan, ling^{Counselsthat the onlyremedyavailable to} the petitione; s is^{to approachthe Waqf Tribunal for setting} aside the Wa, Lf Notification,^{if they are aggrievedby the same,} cannot be ct untenanced^{ancl the same has to be rejected'} The Court w rile^{exercisingpor,'erunder Article 226of' the} Constitution^{>f India is not denuded of the power to deal with} the orders oJ^{the JointCollectorto see whetherthe orders} that are^{pa;sed are inaccordance with the procedure} established^L /^{law or whether there was any violation of the} principles ol natural^{justice.Eventhoughthe learned} Standing^{Co rnsel for the Waqf Board has relied on the} judgment oi the Hon'ble^{Supreme Court inWhirlpool} Corporation^{(supra),but, as a matter of fact' in the said} decision, the^{Hon'ble Supreme Court has heldas under:}

Thus, mere existence of an alternative remedy will not by itself take away the powers of the High Court under Article 226 of the Constitution of India to exercise its^power to review the decision made by the^{quosi judicial} authority.

Moreover, in State Bank oJ India us. M,S. Basi & Ors,3, the Hon'ble Supreme Court has held that the order^is liable to be set aside if no opportuniry of hearing is afforded to the parties who are adversely affected.

Further, irr Mqriamma Rog os. Indion Bank & Ors.a, the Hon'ble Supreme Court has^held that^{even if an} alternative remedy is available, if violation of the^{principles of} natural justice is alleged, the writ^petition is maintainable and the High Court can interfere.

Therefore, the contention of the learned^Standing Counsel that it is only the Waqf Tribunal^{that can go into the} validily or otherwise of the Gazette Notification cannot^be countenanced and the same is rejected.^{The impugned order} passed by the Joint Collector setting aside the order^{of the} RDO granting ORCs without putting the^parties on^notice and without affording them an opportunity of^hearing, violates the well recognized principles of natural^justicei.e' audi alteram partem and the same cannot be^countenanced and is liable to be set aside on this^{sole ground.}

As seen from the record, the only material before the Joint Collector was the Waqf Notification, dated 09.02.1989, and admittedly the Waqf Board was not a^party to the said proceedings nor there was any other material to contend that the subject lands are Waqf lands. In view of the fact that the notification dated 09.02.1989 itself has been held to be invalid and unsustainable and is set aside by this Court in the second batch of writ petitions, the order of the Joint Collector granting ORC in favour of the Waqf Board is also liable to be set aside and the same is accordingly set aside.

It is needless to mention that the Waqf} Board, if it chooses,^{can implead itself beforethe Joint} Collector anc^{placeany other materialbesides notilication} dated 09.02.^{1989, rvhichhas already been set aside,to} buttress theit^{case that the lands in question are Waqf lands} and the sam, shall also^{be taken into considerationby the} Joint Collect rr while^{passing the orders on merits' It is} needless to rr ention^{that all the parties shall be put on notice} and affordec^{reasonableopportunity of hearing,belore} passing of th: orders. It^{is also made clear that pending the} appeals befor^{e the Joint Collector, if the parties alienateor} change the^{r a.ture of the lands, the same will be subjectto} the final orde's^{likely to be passed by the Joint Collector'and} in case any^{i dverseorders are passed, the parties shall not} claim anY^{eqr .ities.}

Insofar as third^{batch of rvrit petitionsfiled aggrievedby} the Notifrcati^{rn issued uncler Sectiorl 22-A of the registration} Act are cor cerned,^{invierv of the fact that the said} notilication^{t as been issuecl basedon thc Notification clated} Og.O2.Lg8g^{: ssued under the Waqf Act, rvhichhas already} been set asi,^{te by this Court, the Notilication issued under} Section 22-A^{of the RegistrationAct has to be necessarilyset} aside and th,^{same is accordingly set aside' Accordingly'the} thircl batch^{c I writ petitionsare allowed'}

In the considered opinion of^{this Court, once the} Division Bench of this Court^{while dismissing the Writ} Appeal i.e., W.A.No.1010 of 2012^{has upheld the order} passed by the learned Single Judge dated^{06.02.2012'by} which the Notification, dated 09'02.1989^{was set aside, the} question of taking a different view in the^{present Writ} Appeals does not arise. Once the^{Notificationhas been held} to be bad in law and the^{land which was subjectmatter of} the Notihcation is again subject^{matter of the same} Notification, this Court does not^{find any reasonto} interfere with the order^{passed by the learned SingleJudge} in allowing the writ^petitions.

Resultantly, the order^{passed by the learnedSingle} Judge in allowing the second^{batch of writ petitions does} not warrant any interference^{and the writ appeals arising} out of second batch of writ^{petitionsare dismissed.}

In the third batch of^{Writ Petitions,the grievanceof} the petitioners therein^{was prohibition of registrationof} Iand on account of a Notiltcation^{under issuedSection} 22-A of the Registration Act^{basedon the Notilication dated} 09.02.1989 declaring the^{lands as wakf. In the considered} opinion of this Court, as^{the Notilicationdated09.021989} has been held to be bad^{in law, the learned Single Judge}

was^{justified nquashing the Notification issuedunder} Section 22-A^{<f the RegistrationAct' Therefore'this Court} does not find^{t ny reasonto interfere with the Order passed} by the learned^SingleJudge'
