This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.CJ, is filed by the petitioner/ Accrrsed No.1 for grant of anticipatory bail in the event of his arrest ir: connection with Crime No. 1047 of 2O2O of K.P.H.B Police Station, Cyberabad, Ranga Reddy District, registered for the offences punishable under Sections 498-4, 354and 509 read with 34 I.P.C.

Heard learned counsel for the petitioner/Accused No.1 and the learned Additional Public Prosecutor representing the respondent/ State. Perused the record.

Learned counsel for the petitioner would submit that the petitioner is innocent of the offences alleged and a false case is registered against him; that ,the petitioner is ready to abide by any condition and r"rltimately, prayed to grant bail to the petitioner.

Learned Additional Public Prosecutor opposed thr: grant of the bail to the ;retitioner.

As seen from the record, it is fact that after filing a petition for dissolution of marriage by the petitioner, th,.e de facto complainant filed the present complaint before the Court concerned, which was referred to the Police concerned under Section 156 (3) Cr.P.C., and thereafter, the present crime has been registered.

Thus, looking into nature of allegations ievelled against the petitioner and considering the facts and circumstances of the case, without adverting to the merits of the case, the petitioner/ accused No. 1 can be granted bail under Section 438 Cr.P.C on some conditions.

Accordingly, the petitioner/ accused No.1 is directed to surrender before the Station House Ofl-rcer, K.P.H.B Police Station, Cyberabad, Ranga Reddy District, within a period of four (4) weeks from today. On such surrender, the Station House Officer, K.P.H.B Police Station, Cyberabad, Ranga Reddy District, shall release the petitioner on bail on hls executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to the satisfaction of the said Station House Officer. On such release, the petitioner/Accused No. 1 shall attend before the said Station House Officer on 3rd Saturday of every month between 1O:00 AM and 2:00 PM till completion of investigation and filing of charge sheet. Further, the petitioner shall abide by the conditions stipulated in Section 438 (2) Cr.P.C and co-operate with the Investigation Officer in concluding investigation. Further, the petitioner shall not threaten the prosecution witnesses. .

Accordingly, the Criminal Petition is allowed.

Miscellaneous petitions, if any, shall stand closed.
