Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the petition and the grounds filed therein, the HigL Court may be pleased to direct the l't Respondent (i.e. Enforcement Directorate) to enlarge/release the petitioner on Anticipatory bail in the event of the petitioner's arrest in connection with the investigation bearing file number ECIR/HYZ013612020 on the file of the Assistant Director, Enforcement, Hyderabad;

The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and the order of the High Court dated 29.04.2021made in I.A. No.2 of 2021 and upon hearing the arguments of Sri D. Pavan Kumar Advocate for the Petitioner, Sri ANIL PRASAD TIWARI. for the Respondent No.l, the Court made the following

This Court by order, dated 02.03,2021granted relief of Anticipatory Bail to this petitioner. The condition imposed while granting the said relief was to surrender the passport and not to leave the territory of India without permission of the Court.

Learned counsel for the petitioner would submit that the petitioner is not an actused in the ECIR and the proceedings against the husband of the petitioner were also qirashed by this Court.

Sri Anil Prasad Tiwari, learned counsel appearing on behalf of the respondent No. I would submit that as on date, the petitioner is not an accused in the ECIR. Keeping in view that the petitioner is not an accused, this Court deems it appropriate to direct the Metropolitan Sessipns Judge, at Hyderabad to return the passport bearing No. M8160488 to the petitioner.
