This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, l973, is filed by the^{petitioner/Al} seeking to^grant bail to him in connection with Crime No.1 83 of²⁰¹ 7 on the^{file of Yadagirigutta} Police Station, Bhongir District, registered for the offences^punishable under Sections 420, 468 and 471 lPC.

Heard leamerl counsel appearing for the^{petitioner/A-1} , learned Additional Public Prosecutor appearing for the respondent-State and perused the record.

Learned courtsel for the^petitioner submits that the allegations made against the letitioner are false and baseless and the^present complaint is lodged'ruith an intention to blackmail the^petitioner. He further submits that no oved acts are attributed against the^petitioner with regard to the alleged cheat ng and no^prima facle case is made out against him, except some abnorrnal grounds. He also submits that the petitioner/Al is in^judicial custody,since 15.12.2020 and he is ready to abide by any condition that may be imposed by this Court in the event of his enlargement on bail.

Learned Additional Public Prosecutor vehemently opposed the bail application and sub nitted that the investigation is not^yet completed and some relevant docJments have to be collected during the course of investigation.

Having regard to the facts and circumstances of the case and looking into the nature of allegations leveled against the petitioner and as

the petitioneriAl is in^judicial custody since 15.12.2020, without adverting to the merits of the case, I am inclined to grant bail to the petitioner/A 1 .

The Criminal Petition is allowed and the petitioner/A1 is directed to

be released on bail, subject to the following terms and conditions:

(i) The petitioner/A-l shall be released on bail on his executing a personal bond to the tune of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum to the satisfaction of the Judicial First Class Magistrate, Alair.

(ii) On such release, the petitioner/A1 shall appear before the lnvestigating Officer on every Saturday between 10.00 AM to 2.00 PM., till completion of investigation or filing of the charge sheet, whichever is earlier. He shall furnish all necessary and relevant documents for the purpose of investigation.

(iii) the petitioner/A1 shall appear before the Court concerned

personally on each date of hearing till conclusion of trial.

¶34

(iv) the petitioneriAl shall not indulge in any similar type of activities, in future;

(v) the petitioner/A1 shall not tamper with the prosecution witnesses;

(vi) the petitioner/A1 shall co-operate with the investigating agency.

(vii) the petitioner/A1 shall not misuse the liberty granted to him. lf he is indulged in similar type of activities in future, liberty granted to him shall stand cancelled automatically.
