Municipal No. II - l -889/5 /Dlll2admeasuring625 square yards was purchased by her husband under tworegistered sale deeds vide documents No.34412012and34512012 and sincethe date of purchase, the petitioner and herhusbandwere in possession of the respective properlies totally admeasuring 1250sq.yards'When the respondent No.2 tried to interfere with thesaid property, during the year 2008, the petitioner filed a suit forperpetualinjunction vide OS No'3692 of 2008 on the file of the IXJunior Civil Judge,City Civil Court' Hyderabad and obtained interirninjunction order, However, as the injunction order was dismissed,an appeal was preierredvide CMA No.l05 of 2006 on the file ofthe XIIIAdditionalChief.ludge(FTC), City Civil Court, Hyderabad,whichwas pendingand statusquowas ordered and the satnewas stillsubsisting' After going through the counter filed by therespondentNo.2 in the said civil suit, the petitioner and her husband filedW.P. No.28205of 2012 beforethis Court and interiminjunctionorders were granted pendingdisposalof the writpetition.The petitionerwas in enjoyment of the said property as absolute owner. Shewas in continuousand unintem'rpted possession, which was confirmed bythis Court in the aboveWrit Petition by grantinginterim injunction,as such, continuation of the proceedings in CC No.385 of2012 was nothing but abuse of process oflaw and prayed toquash the proceedings.
