This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure,^'1973, is filed by the^{petitioner/Al} seeking to^grant bail to him in connecticn with Cr.No.80 ol 2021 onthe file of RGI Airport Police Station, Cyberab'ad, Ranga Reddy District, registered for the offences punishable under Section^g(BXl Xb) of Explosive Act, 1884, Section 5 of Explosive Substances Act, 1908.

Heard learned counsel appearing for the^{petitioner/A-1} , learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the^petitioner submits that there are no allegations against the petitioner nor there is no complaint against him and even the allegations in the alleged panchanama/remand report do not constitute the alleged offences against him. He further submits that even as per the allegations, the petitioner is working as labourer and he is not a supplier of blasting material. He further submits that the petitioner is in judicial custody sirce 30.0'1 .2021 and he is a law abiding citizen and ready to abide by any condition imposed by this Court in the event of his enlargement on bail.

Learned Assistant Public Prosecutor vehemently opposed the bail application and submits that 41 and A2, who are brothers, engaged in stone breaking wc,rk and A3 and 44 are suppliers of blasting material.

A perusal of the remand report shows that the petitioner/Al and his brother-A2 used to engage in stone breaking work and A3 and 44 used to supply the blasting material, and that on 29.01.2021, 41 and A2 kept the blasting material on the slab of the house of 41 in the first floor, but the said material is rrot used for blasting. Thus, looking into the nature of

allegations leveled against the petitioner/A1 and as he is in judicial custody since 30.01.2021 and he has no criminal antecedents prior to this occurrence and since most part of the investigation is completed, except filing of the charge sheet, I am inclined to grant bail to the petitioner/A1 .

The Criminal Petition is allowed and the petitioner/Al is directed to be released on bail, subject to the following terms and conditions:

(i) The petitioner/A-1 shall be released on bail on his executing a personal bond to the tune of Rs.15,0001 (Rupees fifteen thousand only) with two sureties for a like sum each to the satisfaction of the XIV Additional [/etropolitan Magistrate, Cberabad, Rajendranagar.

(ii) On such release, the petitioner/Al shall appear before the lnvestigating Officer on 1tt and 3'd Saturday of every month between 10.00 AM to 2.00 PM., till completion of investigation or filing of the charge sheet, whichever is earlier.

(iii) the petitioner/Al shall . appear before the Court concerned personally on each date of hearing till conclusion of trial.

(iv) the petitioner/Al shall not indulge in any similar type of activities, in future; lf he is Indulged in similar type of activities in future, liberty granted to him shall stand cancelled automatically.

(v) the petitioner/A1 shall not tamper with the prosecution witnesses;

(vi) the petitioner/A1 shall co-operate with the investigating agency. (vii)the petitioner/A1 shall not misuse the liberty granted to him.

Miscellaneous applications, if any^pending in this criminal

petition, shall stand closed.
