The present Writ Petition is filed to declare the action of respondent Nos.2 to 4 in not taking any legal action and not registering the case against respondent No.5 even though the petitioner has submitted a complaint on 14.10.2018, as being illegal, arbitrary and abuse of process of law.

Heard Sri L. Sandeep, learned Counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions dated 04.02.2020, submits that the petitioner herein gave a petition to the Station House Officer, Huzurnagar on 14.10.2018 stating that his daughter-in-law filed false case against his family vide Crime No.310 of 2017 and making her family to go around the court. That on 11.10.2018, she sent a threatening message to his phone stating that she will bring the entire family before media. By the said written instructions, it is stated that on receipt of the above petition, G.D. entry was made and enquiry was done, during enquiry, it disclosed that the allegation made by the petitioner were false, as a case was registered against him in Crime No.310 of 2017, he gave a false petition to the Station House Officer and as there are no contents to register a case, no action was taken thereon and a notice was sent to the petitioner through registered post on 04.02.2020 informing the same.

Having regard to the fact that a notice has been sent to the petitioner by RPAD informing the petitioner of the action taken on the basis of the complaint, it is open for the petitioner to approach appropriate forum to avail remedies in accordance with law, if the petitioner is aggrieved by the said notice.

Subject to the above, the Writ Petition is closed. No order as to costs.

As a sequel thereto, the miscellaneous petitions pending, if

any, shall stand closed. No order as to costs.
