Petition under Section 437 & 439 of Cr.P.C, praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to release the petitioner/accused on bail in connection with Crime No.562 of 2019 on the file of Sanathnagar Police Station, Hyderabad.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of MR.SYED AZMATULLAH Advocate for the Petitioner and ADDL.PUBLIC PROSECUTOR (TG) for the Respondent, the Court made the following.

CRIMINAL PETITION NO.346 OF 2O2O
ORDER:
The petitioner/ accused filed the present Criminal Petition under Sections 437 and 439 of the Code of Criminal Procedure seeking to grant bail to them in Crime No.562 of 2019 of P.S. Sanathnagar, Balanagar Division, Cyberabad, which was registered lor the oflences punishable under Sections 477, 42O and 376 of the lndian Penal Code.
The allegation against the petitioner/ accused is that on the petition er/ accused allegedly cajoled the de facto complainant/victim into consenting for sex on the pretext of false promise to marry her. The petitioner had resorted to the same act time and again and ultimately rejected her when she had insisted for ma rriage.
Learned Additional Public Prosecutor, though opposed to grant bail to the petitioner/ accused, submitted that in spite of receipt of notices issued by the investigating authorities for recording statement under Section 164 Cr.P.C., the de facto complainant is not responding and not co-operating with the investigating authorities.
Learned counsel for the petitioner/ accused submits that tL,e de /acto complainant previously lodged complaint against one Santosh Kumar with the same set of facts and as such she is a habitual offencler. It is further submitted that the police .n'n completed rnvestigation and therefore, release of the petitioner

would not cause any prejudice to the case of the prosecution. The petitioner has got Iixed address and properties and undertakes to produce sureties to the satisfaction of the trial Court and further to co-operate with the trial of the case. Hence, it is prayed to consider the petitioner's application for bail.
Looking into the facts and circumstances of the case and taking into consideration the gravity of the olfence alleged, I am inclined to grant bail to the petitioner/ accused.
The Criminal Petition is allowed and the
petitioner/ accused shall be released on bail on the following terms and conditions:
