ORDER

This writ petition is filed seeking the following relief:

“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering the case of the petitioner for transfer from the present place of working to Z.P.H.S Ramanthapur, Ranga Reddy District, wherein the NCC Unit is available by taking into consideration of the injustice done to him in the transfer counselling though he has made a representation dt 26/08/2019 to the 2^nd respondent narrating all the factual aspects is as illegal, arbitrary, unjust and violative of Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondents to consider the claim of the petitioner for transfer to Z.P.H.S Ramanthapur, Ranga Reddy District, which was fell vacant from 31/10/2019 with all consequential and attendant benefits and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”

for the petitioner and learned Government Pleader for Services-I appearing for the respondents.

It is the case of the petitioner that he is working as School Assistant-cum-Associate NCC Officer in Zilla Parishad High School, Mujahidpur, Kulacharla Mandal, Vikarabad District. He has participated in the transfer counselling, but his case was not considered. Hence, the petitioner preferred

an appeal before the appellate authority and the appellate authority also rejected the case of the petitioner.

Learned counsel appearing for the petitioner contended that though the petitioner has submitted a representation to the respondents on 26.08.2019 to consider his case for transfer to ZPHS, Ramanthapur, Ranga Reddy District, wherein NCC unit is available, the respondents are neither passing any orders on the said representation nor considering the case of the petitioner. It is prayed that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner on 26.8.2019.

Learned Government Pleader appearing for the respondents contended that since the representation submitted by the petitioner is pending with the respondents, the respondents would consider and pass appropriate orders, in accordance with law.

Having considered the rival submissions made by the learned counsel on either side, this Writ Petition can be disposed of directing the respondents to consider the representation dated 26.8.2019 submitted by the petitioner and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No costs.
