This Criminal Petition, under Section 439 of the Code oF Criminal Procedure, 1973, is filed by the^{petitioner/accused,} for^grant of bail in Crime No.62 of 2019 of Bollaram Police Station, Sangareddy, registered for the offence^punishable under Section 304-II of IPC.

Heard thr: learned counsel for the^{petitioner/accused,} the learned Additional Pub ic Prosecutor representing the respondent/State and perused the rec:ord.

The case of prosecution, in brief, is that on 26.04.20L9, the accused^parked h,s vehicle in heavy traffic road and opened driver cabin door, which hit one TVS bike, as a result of which, the said bike fell under the tipper lorry which was coming from behind and the rider of the bike died orr spot and the pillion rider died on the way to hospital.

Learned counsel for the petitioner/accused submits that the I petitioner is Falsely implicated in the said crime. The allegations in the complaint are created for the purpose of altering Section 304-A into 304-II of IPC without there being any culpable homicide or intention and ultimately pralr3d to allow the petition.

Learned Additional Public Prosecutor representing the respondent/State opposed to grant bail to the petitioner/accused and ultimately pray,:d to dismiss the petition.

As per the material placed on record, the petitioner/accused is in judicial custod) from 27.04.2019 and major part of the investigation is

completed. Under these circumstances, without adverting to the merits of the case, this Court is inclined to grant bail to the petitioner/accused on certain terms and conditions.

Accordingly, the petitio ner/a ccu sed is ordered to be released on bail on his executing a personal bond for a sum of Rs.15,000/- (Rupees fifteen thousand only) with two sureties for a like sum each to the satisfaction of the ludicial First Class Magistrate, Narsapur. On such release, the petitio ner/a ccused shall report before the Station House Officer, Bollaram Police Station, Sangareddy, on alternate days between 10:00 A.M. and 5:00 P.M, till filing of the charge sheet. The petitioner/accused shall appear in-person before the trial Court on each and every date of hearing till completion of trial.
