WRIT PETITION No.33682 OF 2018
ORDER :
When the matter is taken up, written instructions, dated
20.09.2018, furnished by the Sub Inspector of Police Buttaigudem Police Station, West Godavari District, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under:
“At the outset it is respectfully
submitted that with regard to the above said lands four criminal cases are registered on the file of Buttaigudem Police Station as follows:
1. Cr.No.119/2016 for the offences u/s 447, 427, r/w 34 IPC and the case is pending trial vide CC.No.68/2017 on the file of the Hon’ble Judicial Magistrate of First Class, Jangareddygudem. The petitioners 1 and 2 are A1 and A2.
2. Cr.No.136/2016 for the offences u/s 447, 427, 506 r/w 34 IPC and the case is pending trial vide CC.No.202/2017 on the file of the Hon’ble Judicial Magistrate of First Class, Jangareddygudem. The petitioners 1 and 2 are A1 and A2.
3. Cr.No.141/2016 for the offences u/s 447, 427, 379, 506 r/w 34 IPC and the case is pending trial vide

CC.No.203/2017 on the file of the Hon’ble Judicial Magistrate of First Class, Jangareddygudem. The petitioner No.1 is A1.
4. Cr.No.21/2017 for the offences u/s 447, 427, 143 r/w 149 IPC and the case is under investigation. The petitioner No.1 is A2 and petitioner No.2 is A3.
It is submitted that the investigating officer except registering the above criminal cases and investigation into by visiting the scene of offence, did not interfered with the life, liberty or property of the petitioners at any point of time.
It is submitted that the contentions of the petitioners that the respondent No.4 Station House Officer, Buttaigudem Police Station, West Godavari District harassed, interfered with the life, liberty and property of the petitioners at the instance of 5th respondent Tahsildar, Buttaigudem Mandal and tried to dispossess them from their agricultural lands under Sy.No.877/1, admeasuring Ac.7.00 cents, situated at Seethappagudem village, Buttaigudem Mandal is incorrect, baseless, far from truth and has been created for the purpose of filing the present Writ Petition.
It is submitted that the petitioners contended in their affidavit to direct the 4th respondent to restore the lands to the petitioners. In this regard it is submitted that the 4th respondent is not the competent authority to restore the land.

It is incorrect to say that since last week, the 4th respondent at the instance of the 5th respondent interfered with the life and property of the petitioners, hence denied.
It is also incorrect to say that the 4th respondent summoned the petitioners to the Police Station through the staff and harassed them and threatened not to enter into their lands, or else the petitioners will be implicated in false cases, hence denied.
It is also incorrect to say that the 4th respondent tried to dispossess the petitioners from their lands, hence denied. It is submitted that the 4th respondent did not interfere with the lands of the petitioners by calling them to the Police Station as alleged by them ”.
By placing on record the above written instructions, Writ
Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
