THE HON’BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.32188 of 2018
ORDER:
An order of suspension of A.4 licence passed vide Rc.No.156/2017/A5, dated 29.08.2018, by the Prohibition and Excise Superintendent, Visakhapatnam/R.4 herein is under challenge in the present Writ Petition. On the allegation that the petitioner herein indulged in brand mixing, the said Order came to be passed.
Today, when the matter is taken up, it is submitted by the learned Counsel for the petitioner that on the request made by the respondents, the samples were sent to the Department of Inorganic and Analytical Chemistry, Visakhapatnam, who gave a report on 24.09.2018 saying that there is no brand mixing in the subject bottles. A copy of the same is placed on record.
In view of the same, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the respondents to conclude the enquiry and pass final Orders and till the said exercise attains finality, there shall be interim suspension of the Order.
Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
