WRIT PETITIION No.2107 of 2018
ORDER:
When the matter is taken up, it is submitted by the learned counsel for the petitioners that, in identical situation, this Court disposed of W.P.No.12199 of 2017 by way of an order, dated 06.04.2017. A copy of the said order is placed on record. The operative portion of the said order reads as under:
“The petitioners submit that when the police issued a notice to the bunks and push cart owners to remove the encroachments, they have not totally removed the encroachments, but they have moved backwards, still occupying the road portion but obstructing free flow of ingress and egress to their shops. If that is so, the petitioners should have brought it to the notice of the concerned police who earlier issued notices to the encroached bunks/push cart owners. In the absence of such representation, this Writ Petition cannot be entertained. However, liberty is given to the petitioners to bring it to the notice of the concerned authorities including police with regard to encroachments by the owners of the bunks/push carts on the road margin and causing obstruction to the ingress and egress to the shops of the petitioners. On receipt of such representation, the concerned authorities shall take necessary action in accordance with law. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs”.
Following the above said order, and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof, giving liberty to the petitioners herein to bring to the notice of the concerned authorities, including the police, with regard to the encroachments by the owners

of the bunks/push carts on the road margin and consequential obstruction to the ingress and egress of the shops of the petitioners herein. On receipt of such representations, the concerned authorities shall take necessary action in accordance with law.
As a sequel thereto, miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
