O R D E R :

This writ petition is filed seeking mandamus to declare

¶5

the action of the respondents in not registering the crime on the

¶6

petitioner’s complaint dated 14/4/2018, as illegal, irrational and

¶7

offends Article 14 and 21 of the Constitution of India and

¶8

consequently to direct the third respondent to register the crime

¶9

and the prosecute the accused and to pass such other suitable

¶10

orders as this Court may deem fit and proper in the circumstances

¶11

of the case.

Heard the learned counsel for the petitioner and the

¶13

learned Assistant Government Pleader for Home appearing for the

¶14

respondents.

The learned Assistant Government Pleader for Home

¶16

submitted written instructions filed by the Inspector of Police,

¶17

¶18

Gudivada I-Town Police Station, Krishna district stating that on

¶19

receipt of the complaint in the office of the Superintendent of

¶20

Police, Krishna on 12/2/2018, the same was referred to the Deputy

¶21

Superintendent of Police, Gudivada vide C.No. 32306/G-2/18 for

¶22

enquiry and necessary action and the same was in turn sent to the

¶23

Station House Officer, Gudivada I-Town Police Station. Thereupon

¶24

Gudivada I-Town Police have enquired into the same by calling the

¶25

petitioner to the Police Station on 23/4/2018 wherein he denied of

¶26

making any such complaint to the Superintendent of Police,

¶27

Krishna district. The same is disputed by the learned counsel for the

¶28

petitioner. It is not known why the petitioner will deny about

¶29

giving complaint and file present writ petition complaining the

¶30

same.

In view of the same, the sixth respondent is directed o

¶32

take action on the complaint in terms of the Hon’ble Supreme

¶33

¶34

Court’s Judgment in LALITA KUMARI V/s. GOVERNMENT OF UTTAR

¶35

PRADESH¹ .

Recording the same, the writ petition is disposed of at the

¶37

admission stage.

As a sequel, miscellaneous petitions if any, pending in this

writ petition shall stand disposed of. No costs.
