O R D E R :
When the matter was listed before this Court on 06.11.2018, a representation was made on behalf of the respondent that the matter is settled out of Court, however, since there was no representation on behalf of the petitioner, the matter was directed to be listed under the caption ‘for dismissal’ on 09.11.2018, on which date also, there was no representation for the petitioner. Even today, there is no representation on behalf of the petitioner.
In those circumstances, it is presumed that the petitioner does not desire to prosecute the matter. In view of the same and as a representation was made on behalf of the respondent that the matter was settled out of Court, but no application as required under Rule 100 of the Company (Courts) Rules is filed, the Company Petition is dismissed for non-prosecution.
