This petition is filed with the following prayer:

“ …to issue a Writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the 3^rd respondent in insisting on the petitioner to get occupancy certificate for the purpose of releasing electricity supply to the premises of petitioners bearing Plot No.344A, in Survey No.403/1 of Shaikpet Village, admeasuring 581.44 square yards or equivalent to 486.15 Sq.Mts, situated at MLAs Colony, Road No.12, Banjara Hills, Sakikpet Mandal, Hyderabad, as being illegal, arbitrary and violative of Article 14 of the Constitution of India, and consequently direct the third respondent to release power supply to the premises of the petitioners without insisting for production of occupancy certificate from the fourth respondent and to pass such other order or orders as this Hon’ble Court may deem fit……”

Heard learned counsel for the petitioner who submits that the ‘lis’ in the writ petition is squarely covered by the order dated 14.09.2017 passed by this Court in WP.No.31189 of 2017; and the same is not disputed by Sri R.Vinod Reddy, learned Standing Counsel for respondents 2 & 3.

Sri Sampath Prabhakar Reddy, learned Standing Counsel appeared for the 4^th respondent.

Recording the aforesaid submission of the learned counsel, the writ petition is disposed of with a direction to respondents to release the power supply to the premises of the petitioners subject to the compliance of the terms and conditions of supply and on furnishing an undertaking to produce the occupancy certificate from the concerned Municipality/Municipal Corporation, within a period of three months, and if no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action in accordance with law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending

in the writ petition, shall stand closed.
