ORDER:
This writ petition is filed challenging the provisional assessment notice issued by the 3rd respondent.
Learned counsel for the petitioner says that tenant was staying in the house by playing mischief and the petitioner will face enquiry and they used to get monthly bill of Rs.1500/- to Rs.3000/and on the face of it, the impugned assessment is arbitrary. The said contention is opposed by learned Standing Counsel for the respondent-Corporation saying that because of theft of electricity only the assessment was made.
Learned counsel for the petitioner says that petitioner wants to pay the amount and the power supply may be restored.
In view of the same, there shall be direction to restore the power supply to the petitioner on payment of Rs.90,000/- (Rupees Ninety thousand only). However, this order will not prelude the Special Court from fixing civil liability under Section 154(6) of the Electricity Act and the petitioner shall cooperate with the enquiry.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
