After arguing for some time, Sri P. Ananth Nageswar Rao, learned counsel for the petitioner, would submit that, in terms of the undertaking furnished to this Court, the petitioner be permitted to withdraw the Writ Petition with liberty to approach the 1^st respondentbank requesting them to grant the petitioner breathing time to pay the entire debt due; and the petitioner would pay Rs.3,50,000/- forthwith; and the balance within a few months thereafter.

While this Court would not, in proceedings under Article 226 of the Constitution of India, regulate the mode and manner of repayment of the debt due to banks, we have no reason to doubt that, on a request made by the petitioner, the 1^st respondent-bank would give it its due consideration.

Granting liberty to the petitioner to approach the 1^st respondentbank seeking re-scheduling of the debt, the Writ Petition is dismissed as withdrawn. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
