in T.S.No.7/2), situated at Santha Bazar Street, Chirala Town and Mandal, Prakasam District, as per entries in Section 43 Register, Extract of Town Survey Field Register and copy of the location sketch issued by the Commissioner, Chirala Municipality. The petitioner was an encroacher over the temple property. Proceedings for eviction were initiated under Section 83 of the Hindu Religious and Charitable Institution Endowments Act, 1987, (hereinafter, ‘Act 30 of 1987’). She was evicted from the p[property of the 3rd respondent temple vide orders, dated 25.08.2007, in O.A.No.67 of 2005 of the Deputy Commissioner, Endowments Department, Guntur. In the said OA, the petitioner engaged a counsel and strongly contested the case. The said OA was disposed of along with a batch of OAs in O.A.Nos.66 of 2005, 68 of 2005, 69 of 2005 and 70 of 2005. On 04.08.2002, the encroachers in the other OAs handed over possession of the Temple properties in their respective possessions. However, the petitioner failed to hand over possession of the property in her possession as an encroacher. Hence, the 2nd respondent, the Assistant Commissioner of Endowments Department, Ongole, executed eviction orders and removed the encroachment made by the petitioner and handed over the possession of the property to the Manager of the 3rd respondent temple, in the presence of Circle Inspector, Inkollu, Tahasildar, Chirala, and Inspector of Endowments, Ongole. The possession was taken over, on 07.09.2012, by the Assistant Commissioner under Section 84 of Act 30 of 1987 and the sheds were demolished at 10.00 a.m., on 11.09.2012, and vacant possession was handed over to the temple. In fact, the possession of the shops was handed over by the encroachers voluntarily to the Manager of the temple on 04.09.2012 and the shops were demolished at 10.00 a.m., on 11.09.2012.
