WRIT PETITION No.13252 of 2017

ORDER:

This Writ Petition is filed challenging registration of FIR No.238 of 2015 dated 20.03.2015 on the complaint lodged by the second respondent to the Commissioner of Police.

The second respondent – Commissioner of Greater Visakhapatnam Municipal Corporation, in his complaint stated that three individuals have divided the tank poramboke in Survey No.2 giving a separate sub division of Survey No.3, denoting as Survey No.3/11 and sold an extent of Ac.2.55 cents to different individuals by fabricating the documents. On the basis of the said complaint, the above crime was registered and investigation was taken up. When the petitioners are shown as accused and were produced before the concerned Magistrate for remand, the learned Magistrate passed an order directing the accused to furnish surety for Rs.5,000/- for their appearance before the Court whenever necessary, and the investigation officer was directed to take further action pursuant to registration of Crime No.238 of 2015 against accused Nos.1 to 3 in future.

The present Writ Petition is filed on the ground that the first petitioner earlier filed W.P.No.6552 of 2015 alleging interference of the second respondent with her land and the present complaint is a counter blast to the same.

The entire dispute concerns with the land of an extent of Ac.2.55 cents in Survey No.3/11 and the matter requires investigation. In view of the same, this Court is not inclined to entertain the present Writ Petition.

The Writ Petition is, accordingly, dismissed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
