HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION Nos.16603 of 2016 and 12353 of 2017 COMMON ORDER:

Heard the learned counsel for the petitioner and Sri V.Narasimha Goud, learned Standing Counsel for Hyderabad Metropolitan Development Authority.

These Writ Petitions are filed questioning the tender notification dated 21.04.2016 issued by respondent No.2 – Hyderabad Metropolitan Development Authority.

Counter affidavits are also filed by the respondents.

Though initially petitioner raised various contentions, he filed an affidavit dated 13.04.2017 before this Court stating that, if time is granted, he would vacate the kiosks in question by 30.06.2017 and handover vacant possession to respondent - authorities.

Sri Narasimha Goud, learned Standing Counsel for respondent No.2, on instructions, submits that, the undertaking given by the petitioner may be accepted and, he be allowed to continue in the kiosks in question till 30.06.2017.

In the light of the developments that had taken place, it is made clear that the petitioner shall be liable for punishment under the Contempt of Courts Act, and the undertaking of the petitioner is accepted permitting him to continue in the subject kiosks till 30.06.2017. Interim

order granted earlier, if any, stands dissolved. However, there is no impediment for the respondents to proceed further with finalization of tender, and the new incumbent shall be handed over possession with effect from 01.07.2017.

The Writ Petitions are, accordingly, disposed of.

Consequently, miscellaneous petitions pending, if any, in these two writ petitions shall stand dismissed. No order as to costs.
