her statement during investigation with selfsame version is that she is the Director (HR) of the entity Market Tools Research Private Limited, Hyderabad (for short ‘MTRPL’) involved in market research activities with about 215 employees in various teams and there is software development team consisting of 5 members who are working under the control of Mr. Venkat Mantha, who is the Director, Software Development and the team works in their Office at First Floor, Phase IA and Third Floor, Phase 1B, Cyber Pearl, Hitech City, Hyderabad. That Mr. Venkat Mantha jointed MTRPL on 20.02.2006 and is in service and for various reasons company decided to eliminate his position of Director Software Development and terminate his service and he was informed on 01.02.2008 that his services would not be required with effect from 29.02.2008 and therefrom he developed ill-will and logged with ID vmantha into the network of company on 06.02.2008 and removed various files, folders, databases and other software programs from the individual computers of his team and from the servers on the network and the team members, who had logged into the system, realized that he has logged into the system remotely and was doing this mischief. However, due to the illegal action of him various project materials, software programs are found to be missing from the files of the company, the particulars given and after preliminary assessment of the damage, thereby he committed the theft of company’s intellectual property. Hence to take action.
