This petition is filed to withdraw O.P.No.1128 of 2015 from the file of Family Court, City Civil Court, Hyderabad and transfer the same to Family Court, Vijayawada.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 15.12.2013 at Aryasamaj, Hyderabad. She was abonded by respondent in the year 2014, she is now living at Vijayawad and she has no male assistance to travel to Hyderabad from Vijayawada to defend O.P. filed by respondent. She also stated that she is also not having financial capacity to meet the travel expenses from Vijayawada to Hyderabad. It is stated that respondent is a resident of Khammam and O.P. is filed at Hyderabad to cause prejudice to her. It is stated that she being women and unemployee having no male assistance it is difficult for her to travel from Vijayawada to Hyderabad. For these reasons, she prayed for transfer of O.P.No.1128 of 2015 on the file of Family Court, City Civil Court, Hyderabad to Vijayawada.

3. Heard both sides. Perused the affidavit filed in support of the petition. Respondent has not filed any counter.

4. Advocate for respondent submitted that M.C. filed by wife is pending before Additional Family Court-cum-XIV Additional District Judge, Vijayawada. Therefore, instead of transferring it to Family Court, Vijayawada, it may be transferred to Additional Family Court-cum-XIV Additional District Judge, Vijayawada.

5. Considering submissions of both sides and considering

reasons stated in the affidavit filed in support of the petition, O.P.No.1128 of 2015 is withdrawn from the file of Family Court, City Civil Court, Hyderabad and transferred to Additional Family Court-cum-XIV Additional District Judge, Vijayawada, for disposal in accordance with law. Additional Family Court-cum-XIV Additional District Judge, Vijayawada shall dispense with the presence of respondent/husband for each and every adjournment. However, he shall appear as and when his physical presence is felt necessary for any specific purpose.

6. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
