ORDER :
Heard learned counsel for the petitioners and learned Standing counsel for Greater Hyderabad Municipal Corporation.
2. On 17.07.2015 when the matter was taken up for consideration for admission, on the allegation of illegal encroachment by the authorities of respondent-Municipal Corporation and attempting to remove the fencing wire and by using proclainers, learned Standing Counsel representing the Municipal Corporation, on instructions, submitted that the concerned Assistant City Planner, Circle No.10, GHMC, Khairatabad, the GHMC is not indulging in clearing the debris or removing the fencing and that may be private persons were indulging in such activity but not the GHMC.
3. Today, when the matter is taken up for consideration, learned Standing counsel reiterated that GHMC is not interfering with the subject property in any manner. If the GHMC intend to acquire the said land for any public purpose, it would follow the due process as mandated by law. He also categorically states on instructions from the concerned officers of the GHMC, that they have not interfered with the possession of the petitioners nor they intend to interfere with the possession of the petitioners.
4. Having regard to the said statement of the learned Standing counsel, the grievance of the petitioner that the authorities of the Municipal Corporation, are trying to dispossess the petitioner, no more survives and accordingly, the Writ Petition is closed as no further orders are necessary. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
