THE COURT MADE THE FOLLOWING:
ORDER:
This contempt case is filed alleging wilful disobedience of order dt.12.11.2014, in W.P. No.34103 of 2014.
By the above mentioned order, this Court directed the respondents to restore the power supply on the petitioner paying 50% of the provisional assessment amount and, within two months from the date of receipt of such amount, to refer the dispute relating to adjudication of the petitioner’s civil liability to the Special Court under Section 154(5) of the Electricity Act, 2003.
In the contempt case, the grievance of the petitioner is two-fold, namely, that the respondents have not supplied all the material, including the calculation sheet based on which the impugned provisional assessment is made, and that the dispute relating to the petitioner’s civil liability has not been referred to the Special Court.
Respondent No.3 has filed a counter affidavit wherein it is inter alia stated that as regards the criminal liability the petitioner has got the same settled through Award, dt.6.12.2014, before the Metropolitan Legal Services Authority, by paying compounding fee of Rs.37,000/- and that the civil liability of the petitioner was referred to the First Additional Metropolitan Sessions Judge, Nampally, vide SR. No.1426 of 2015. It is further stated that as per the directions of this Court the relevant documents were also handed over to the petitioner. Respondent No.3 has tendered apology for the delay in implementation of the order.
In the light of the above noted averments made by respondent No.3 in his counter affidavit, this Court is satisfied that the respondents have complied with the order of this Court dt.12.11.2014 albeit belatedly.
The contempt case is therefore closed.
