ORDER: (per Hon’ble Sri Justice K.C.Bhabu)

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“to issue a writ, order or direction especially one in the nature of writ of certiorari calling upon the records pertaining to the orders passed in O.A.No.6912 of 2013, dated 14.02.2014 by the Hon’ble Tribunal and quash the same; b) to declare that the proceedings, dated 17.09.2013 of the 3^rd respondent are illegal and arbitrary and further declare that the respondent shall be restrained from directing the petitioner to appear before the medical board.”

Petitioner herein filed the aforementioned Original Application to declare the action of the District Educational Officer, Nalgonda in insisting her to go before the Superintendent, Gandhi Hospital, Hyderabad, vide proceeding, dated 17.09.2013 for obtaining fresh handicapped certificate; and to declare that the respondents are restrained from directing her to appear before the Gandhi Medical Hospital either on 18.09.2013 or any other subsequent date by considering her certificate, dated 10.05.1999, issued by Gandhi Hospital, Secunderabad and 17.07.2000 issued by District Medical Board, Sangareddy, Medak District. The Tribunal after considering the material on record, held that the applicant is directed to cooperate with the respondents and the respondents are directed to proceed with reverification as per the provisions of G.O.Ms.No.31, dated 01.12.2009.

4. If really the applicant is a physically handicapped person, she is entitled for reservation and she should not have objected for reexamination. However, the order passed by the Tribunal is slightly modified and directing the applicant to co-operate with the respondents to undergo re-verification of physically handicapped status before the Medical Board in Osmania General Hospital, Hyderabad.

5. With the above direction, the Writ Petition is disposed of, however, in the circumstances, without costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
