WRIT PETITION No.5438 of 2008
ORDER:
This Writ Petition was filed challenging the action of the respondent in sealing the shops of the petitioners and trying to forcibly evict them from their shop Nos.4, 8 and 16 situated at the shopping complex known as Municipal Prakasam Complex at Narsimharaopet, Eluru, as arbitrary and illegal.
This Court, by order dated 22.04.2008, directed the respondent to open the seals of the petitioners’ shops, subject to payment of the enhanced rent pursuant to the notice that may be given by the respondent and on further paying a sum of Rs.1,00,000/- by the first petitioner and Rs.1,50,000/- by the second petitioner, which would be subject to the result of the Writ Petition.
Thereafter, when the respondent issued a notice of demand seeking enhancement of rent, the first and second petitioners filed W.P.No.698 of 2009. In view of the consideration of the subsequent Writ Petition and in view of opening of the seals of the petitioners’ shops, nothing survives in the present Writ Petition.
The Writ Petition is accordingly closed. The miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
