Order:
This Writ Petition is filed for the following substantive relief:
“…to issue a writ order or direction more particularly one in the nature of Writ of Mandamus, by declaring the action of the 3rd respondent in issuing the order vide Letter No.E2/1864/2014 dated 11-112014 and reinstating the 5th respondent as Fair Price Shop dealer of shop No.4, Balnepally Village, Damaracharla Mandal, Nalgonda District, as illegal, arbitrary, against the rules of A.P.S.P.D.S. and unconstitutional, consequently set aside the order of the 3rd respondent passed vide Letter No.E2/1864/2014 and enquire the issue basing on the report submitted by the
4th respondent dated:09-12-2014 and take necessary action against the 5th respondent as per law.”
After arguing the case, Mr. Challa Srinivasa Reddy, learned Counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition, with liberty to his client to file an appeal against the impugned order.
The request of the learned Counsel for the petitioner is accepted and the Writ Petition is, accordingly, dismissed as withdrawn, with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, WPMP.No.49677 of 2014, filed by the petitioner for interim relief, is dismissed as infructuous.
