WRIT PETITION No.38196 of 2014

ORDER:

This writ petition is filed by the petitioner seeking declaration that the action of the 7^th respondent in proposing to get approval of the 2^nd and 6^th respondents for promotion of 8^th respondent to the post of Lecturer/Senior Lecturer in the Polytechnic Institution of the 7^th respondent without considering petitioner’s eligibility, qualification and seniority, as illegal and contrary to the A.P. Technical Educational Service – Special Rules issued under G.O.Ms.No.178 dated 09.12.2005 and All India Council for Technical Education Norms and other Rules framed from time to time and consequently direct respondents 2 to 7 to consider petitioner’s seniority for the post of the Senior Lecturer post in the 7^th respondent-Polytechnic Institution.

2. Learned standing counsel appearing for Respondents 2 to 4 and 7 filed written instructions obtained from the 3^rd respondent before this Court. Instruction No.12 reads as follows:

“No proposals recommending the name of Smt. D. Vandana, Lecturer for the post of Senior Lecturer were submitted by this office and also no proposals recommending the name of Smt. D.Vandana, Lecturer for the post of Senior Lecturer is received from the 7^th respondent (Principal, SPW Polytechnic, Tirupati) by this office.”

3. In view of the instructions, learned standing counsel appearing for respondents 2 to 4 and 7 submits that no seniority list so far has been published.

4. Recording the said submission, the writ petition is dismissed as premature at the stage of admission. No order as to costs. The miscellaneous petitions pending, if any, shall stand closed.
