This writ petition is filed under Article 226 of the Constitution of India for mandamus seeking a direction to declare the action of the respondents herein in not continuing the petitioner in the out of designation duties i.e. other than the conductor till the recovery from the ill-health of the petitioner herein in spite of submitting the written representation dated 22.09.2014 as arbitrary and illegal.

Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.

Having regard to the facts and circumstances of the case, I am of the considered view that there shall be a direction to the respondents to consider the representation, dated 22.09.2014 submitted by the petitioner.

Accordingly, the writ petition is disposed of directing the respondents to consider the representation, dated 22.09.2014 whereunder the petitioner sought to allow him to duties other than the conductor, within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, filed in this writ petition shall stand closed.
