This writ petition is filed challenging the order, dated 13.8.2014, in O.A.No.4900 of 2014 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short, “the Tribunal).

Petitioner herein/applicant filed the aforementioned Original Application before the Tribunal to declare proceedings, dated 11.8.2014, of respondent No.3 asking her to appear before him and submit relevant documents relating to her date of birth as illegal and arbitrary and consequently, to set aside the same.

The Tribunal, upon considering the material on record, dismissed the aforementioned Original Application on the ground that as respondent No.3 - Medical Officer is working at the same place where the applicant is working, she could have approached him seeking some more time, in case she requires time. Challenging the same, the applicant filed the present writ petition.

Case of the applicant is that she is working as Multi Purpose Health Assistant (Female); that the dispute in this case is with regard to her date of birth; that she filed copy of Secondary School Certificate and also copy of Service Register showing her date of birth as 05.04.1958; that Lokayuktha as well as Tahsildar, Jangareddygudem made enquiries in this regard at the instance of one person and found that there were no grounds for taking cognizance in the matter; that respondent No.3, under whom she is working, gave notice, dated 11.8.2014, to her calling upon her to produce her Date of Birth Certificate and other related papers, and also explanation as to why criminal proceedings cannot be launched against her and that no material was placed to show final result of the enquiry before Tahsildar, Jangareddygudem.

5. Learned counsel for the petitioner/applicant contended that due to typographical mistake, the date was wrongly mentioned in the Secondary School Certificate and that the petitioner is ready to give her explanation if reasonable time is granted to her.

Considering the facts and circumstances, the petitioner is directed to submit her Date of Birth Certificate, Secondary School Certificate and relevant certificates submitted by her at the time of opening the Service Register, and give her explanation to the notice, dated 11.8.2014, to respondent No.3 herein within one (1) week from the date of receipt of a copy of this order and thereafter, appropriate decision has to be taken by respondent No.3 herein in accordance with law.

7. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
