The Court made the following:
ORDER:
This Writ Petition is filed for the following substantive relief: “to pass an order, direction or writ more particularly one in the nature of writ of mandamus declaring the high-handed and illegal action of the respondents in trying to dispossess the petitioners over their respective house sites i.e., Western Portion of House Bearing Municipal No.16-11-741/C/B/1, admeasuring 151 sq.yds and Eastern Portion of House Bearing Municipal No.16-11-741/C/B/1, admeasuring 151 sq.yds, situated at Moosaram Bagh, Opp: MCH Park, Hyderabad by interfering with their peaceful possession and enjoyment of petitioners without following the due process of law as it being illegal, arbitrary, unconstitutional and consequently, to direct the respondents not to dispossess the petitioners from their respective properties by interfering with their peaceful
possession and enjoyment of petitioners.”
After arguing the case, Sri G.Rajeshwar Reddy, learned counsel for the petitioners, requested for permission of the Court to withdraw the Writ Petition with liberty to his clients to file a civil suit for appropriate relief.
The Writ Petition is, accordingly, dismissed as withdrawn, without adjudicating on the merits of the case, with liberty to the petitioners in terms of the prayer made. As a sequel to dismissal of the Writ Petition, interim order, dated 23.09.2014, is vacated and WPMP.Nos.40017 and 40018 of 2014 are dismissed as infructuous.
