WRIT PETITION No.28004 OF 2014

ORDER:(per Hon’ble Sri Justice K.C.Bhanu)

This Writ Petition, under Article 226 of the Constitution of India, is filed to call for the records relating to the Order, dated 09.09.2014, in Original Application No.5350 of 2014 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad (for short, ‘the Tribunal’) and quash the same, consequently direct the respondents to appoint the petitioner as Junior Analyst in one of the vacancies available in Warangal Zone against roster point meant for Scheduled Caste out of the total cadre strength of 6 of Junior Analyst posts.

2. In view of the fact that the interim prayer and the main prayer are one and the same, the Tribunal ordered notice. Challenging the same, the present writ petition is filed.

3. Unless the issue with regard to finalisation of the Zonal seniority out of the eligible candidates in the feeder category is finalised, giving promotion does not arise. This Court cannot decide the said issue exercising the powers under Article 226 of the Constitution of India and the same has to be decided by the Tribunal. Therefore, there are no grounds to interfere with the order of the Tribunal.

4. Accordingly, the Writ Petition is dismissed. However, the official respondents are directed to file counters in the Original Application within a period of four (04) weeks from the date of

receipt of a copy of this order and on filing such counters, we request the Tribunal to dispose of the Original Application within a period of four (04) weeks thereafter. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
