ORDER: (per Hon’ble Sri Justice K.C.Bhanu)
This Writ Petition, under Article 226 of the Constitution of India, is filed to declare the e-Auction sale notice, dated 28.07.2014, issued by respondent No.2 Bank, as arbitrary and illegal and consequently, direct the respondents not to conduct sale of petitioners properties till disposal of C.C.No.224 of 2013 on the file of the Andhra Pradesh State Consumer Disputes Redressal Commission, Hyderabad.
2. Learned counsel for the respondent Bank contended that on 28.07.2014, the respondent-Bank has not conducted e-Auction and Bank will take steps to conduct e-Auction afresh and therefore, cause in this Writ Petition does not survive for further adjudication.
3. Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
