This Writ Petition, under Article 226 of the Constitution of India, is filed to declare the inaction of the respondents in furnishing the statement of house loan account No.30430722581 as on 28.08.2014 to enable the petitioners to discharge the entire balance loan amount due to the bank and on the other hand refusing to furnish the statement and refusing to permit them to discharge the balance loan amount with a view to knock away their house property for a throw away price in favour of an interested person at Eluru Branch, as illegal and arbitrary and consequently to direct the respondents to furnish the statement of account of the house loan A/c.No.30430722581 showing the balance outstanding loan amount as on date and also direct the respondents to receive the entire balance loan amount from the petitioners within the time fixed by this Court.

2. Heard both sides.

3. An innocuous prayer has been sought for in this writ petition seeking furnishing of statement of house loan account to discharge the entire balance amount due to the bank. 4. Therefore, there is no impediment in directing the respondent bank to furnish the statement of account immediately to the petitioners on their approach to the bank under proper acknowledgement.

5. Accordingly, the Writ Petition is disposed of directing the respondents to furnish the statement of account to enable the petitioners to discharge the outstanding loan amount due to the bank. However, this order will not preclude the bank from proceeding further in accordance with the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
